1. Eligibility: Sweepstakes (the “Sweepstakes”) is open only to those who enter their details in the entry form and who are 18 as of the date of the entry. The sweepstakes is only open to legal residents of the European Economic Area (EEA), United Kingdom (UK), Switzerland, or Norway. Employees of Burton Sportartikel GmbH (the “Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes.
2. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Burton Sportartikel GmbH, as final and binding as it relates to the content. The Sweepstakes is subject to all applicable federal, state and local laws.
3. Sweepstakes Period: Entries will be accepted online starting on 28.10.2024 and ending on 10.11.2024. All online entries must be received by 10.11.2024 11:59 PM GMT+1.
4. How to Enter: The Sweepstake can be entered by completing the registration form on the Landingpage: Step On Giveaway - Splash (splashthat.com). To take part in the Sweepstakes, it is necessary to accept these Rules. The entry must fulfil all sweepstakes requirements according to point 1. to be eligible to win a prize. The Sponsor will collect the following contact data: First name, last name, address, postal code, city, e-mail address, Step On® Boot size, Step On® Binding size, date of birth, gender. Entries that are not complete or do not adhere to the Rules or specifications may be disqualified at the sole reasonable discretion of the Sponsor. You may enter only once, and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the Rules. If you use fraudulent methods or otherwise attempt to circumvent the Rules your submission may be removed from eligibility at the sole reasonable discretion of the Sponsor.
5. Prize: QTY (2) winners will receive (1) pair of Step On ® Boots & Bindings (retail value €910,00EUR). Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor's discretion. The prize is non-transferable. Any and all prize-related expenses shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for the Sponsor to use winner's name, likeness, and entry for purposes of advertising on Websites and Social Media in the context of the Sweepstakes without further compensation.
6. Odds: The odds of winning depend on the number of eligible entries received.
7. Winner selection and notification: Winners of the Sweepstakes will be selected in a random drawing under the supervision of the Sponsor. Winners will be notified via email to the email address they entered the Sweepstakes within five (5) days following the winner selection. The Sponsor shall have no liability for a winner's failure to receive notices due to the winner’s spam, junk e-mail, or other security settings or for the winner’s provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 5 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize may be forfeited, and an alternate winner selected. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
8. Data: The following supplementary data protection guidelines apply to the processing of your personal data in the context of the sweepstake. When participating or registering, the following data may be collected about you: First name, last name, address, postal code, city, e-mail address, Step On® Boot size, Step On® Binding size, date of birth, gender. This data is processed for the purpose of running the sweepstake, e.g. for determining and notifying the winner and for sending or providing the prize. If it is necessary for sending or providing the prize, the contact details of the winners will be transmitted to the company entrusted with sending or providing the prize. The legal basis for this is the fulfillment of a contractual relationship (Art. 6 para. 1 lit. b GDPR). Also, prize winner’s data will be used for purposes of advertising on Websites and Social Media in the context of the Sweepstakes. Unless there is a statutory data retention period or the data is required due to subscription to our e-mail newsletters, and/or text marketing, the stored personal data of the winners will be deleted by the Sponsor no later than two years after the end of the campaign, the notification of the winners and the handover of the prizes all in connection with the campaign. The stored personal data of the remaining participants (who did not win) will be deleted after three months at the latest, unless there is a statutory data retention period or the data is required due to subscription to our e-mail newsletters, and/or text marketing. 9. Terms: The Sponsor reserves the right, in its sole reasonable discretion, to cancel, terminate, modify or suspend the Sweepstakes should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, the Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Terms & Conditions. The Sponsor has the right, in its sole reasonable discretion, to maintain the integrity of the Sweepstakes, to void votes for any reason, including, but not limited to, multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by sweepstakes Rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person.
10. Limitation of Liability: Sponsor is only liable for damages caused intentionally or by acts of gross negligence by Sponsor or one of its vicarious agents, for example from (i) such entrant's participation in the sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries. This above limitation of liability to intent and gross negligence does not apply to damage caused by injury to life, physical injury and/or damage to health.
11. Disputes: Legal recourse for the receipt of a prize is excluded. THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF AUSTRIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. 6020 Innsbruck is agreed as the exclusive place of performance for all deliveries/services and payments on both sides.
13. Winners List: To obtain a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Burton Sportartikel GmbH, Hallerstrasse 111, 6020 Innsbruck, Austria/Tirol. Requests must be received no later than 10.11.2024.
