The sponsor of this Giveaway is Micron Consumer Products Group, a division of Micron Semiconductor Products, Inc., which operates Crucial.com (“Crucial” or “Sponsor”). By participating in this Giveaway (“Giveaway”), you (“you” or "Participant") agree to these terms and conditions. If you do not agree to the terms and conditions, do not participate.
No Purchase Necessary. A purchase will not increase your chances of winning. This agreement includes certain indemnification obligations of participants.
How to Enter: To enter, you must perform the action required as specified in the applicable Crucial MCPG Technology giveaway announcement. Unless otherwise stated, the limit is one entry per participating business, per person, per household, and per e-mail address. The Giveaway shall run through the end date specified in the applicable announcement. Odds of winning depend on the number of eligible entries received.
License to and Representations for Submissions:
License Grant. By entering the Giveaway, Participant agrees to and does hereby grant to Crucial, its parent company, subsidiaries, affiliates, partners and marketing Sponsor, a perpetual, irrevocable, worldwide license to copy, reproduce, publish, distribute, display, make derivative works of and use in any manner all Submissions in any media or manner whether currently existing or arising in the future without any further consideration to be provided to Participant.
Publicity Grant. Except where otherwise prohibited by law, Participant grants to Sponsor, without any right of further compensation, the right to use Participant’s name, image, likeness and any personal story or information included with a Submission in connection with Sponsor’s and its subsidiaries’ business activities.
Warranty. Participant represents and warrants that the Submission is an original work created and solely by Participant, and that it does not infringe any copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, that you are authorized to grant the licenses and other rights provided for in this Agreement, and that no other party has any right, title, claim or interest in the Submission or any materials included therein. The Submission must not, in the sole discretion of the sponsor, contain any obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content. Crucial.com reserves the right to remove and disqualify any entries that, in its sole discretion, do not comply with these requirements.
Winner Selection:
Prize Selection. Sponsor will select the potential winner(s) through a random drawing among all Participants on the date identified in the applicable announcement. Once a potential winner is selected, the potential winner will be notified by e-mail. The potential winner must provide information requested by the Sponsor to establish eligibility, including at a minimum the winner’s first and last name, email address, shipping address, and telephone number. Except where otherwise prohibited, a potential winner will be required to sign all releases and consents (and, if applicable, obtain all third party releases and consents) and affidavits or statements of eligibility that Sponsor deems necessary and provide such personal information as the sponsor may request, including personal information used for purposes of tax documentation. Potential winners of prizes over $600 will be required to provide a tax file number or other applicable tax identifier for tax reporting purposes. In certain jurisdictions, a potential winner may also be required to provide a response to skill testing questions. For example, potential winners who are residents of Canada will be provided with a skill testing question prior to being qualified as a prize winner. Failure to execute such releases and consents within ten (10) days of first attempted notification will result in the disqualification of such potential winner and another potential winner shall be selected by Crucial.com. Prize(s) will be shipped to qualified winner(s) within three (3) weeks of final determination of eligibility and winner status. Sponsor’s decisions on all matters under this Giveaway will be final and binding on Participants.
Chance of Winning. Participant’s chance of winning is dependent upon the number of entries received.
Prizes:
Prizes. The winner will receive the prize(s) specified in the giveaway announcement or a prize of equivalent value as determined by the Sponsor in its sole discretion. Prizes may also vary in exact model depending on region the winner lives in. Grand Prize winner will get two kits (4 sticks total of memory)
Limitations. All prizes are non-transferrable, non-exchangeable and are not redeemable for cash. Winners are solely responsible for ensuring appropriate reporting and payment of ALL EXPENSES, TAXES, AND COSTS ASSOCIATED WITH ACCEPTANCE AND USE OF THE PRIZE.
5. Eligibility: This Promotion is open to the general public, ages 18 years and older (or the age of legal majority in the entrant’s state/jurisdiction of residence if greater). To be eligible, entrant must be a legal resident of the United States, United Kingdom, European Union, Canada (excluding Quebec), unless otherwise stated in the applicable Giveaway announcement. Employees of Micron Technology, Inc. (“Micron”) and its subsidiaries, affiliates and advertising and Giveaway agencies, and the family members and/or those living in the same household of any such employees are not eligible. Sponsor reserves the right in its sole discretion to disqualify any Participant who it has reason to believed has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the Giveaway.
6. General Conditions: This Giveaway shall be controlled by the laws of the State of Idaho, and applicable federal and state laws shall apply. By entering you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize award shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Ada County, Idaho.
7. Privacy: Participants may be asked to disclose contact and demographic information as well as additional personal ("Personal Information"). If, during the submission process you choose to opt in to receive marketing or other Giveaway information, Sponsor may use your Personal Information to send you information about Sponsor's company, contact you when necessary, tailor your experience at Sponsor's site, display information according to your preferences and improve Sponsor's Web sites, products and advertising. If you do not want to receive any communication from Sponsor, you may choose not to opt in to receiving any communication that is not part of this Giveaway. By entering the Promotion, you also agree to the terms of Sponsor's Privacy Policy, which is available at https://www.crucial.com/usa/en/company-privacy, and is incorporated herein by reference. A request to access, update or correct your Personal Information should be directed to crucial.service@micron.com.
8. Severability: A term or part of a term of these terms and conditions that is illegal or unenforceable may be severed from these terms and conditions and the remaining terms or parts of the term of these terms and conditions continue in force.
9. Release and Indemnity: Participant agrees to and does hereby release, indemnify and hold harmless Sponsor its parents, subsidiaries and affiliates (collectively, the “Micron Group”) and the Micron Group’s employees, representatives, officers, directors and agents from and against any and all liability, loss, damage, or injury relating to this Promotion or awarding, receipt, possession use, and/or misuse of any prize awarded herein and acknowledge that neither the Micron Group nor its employees have made or are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied , in fact or in law, relative to any prize including, but not limited to, its quality, mechanical condition, or fitness for a particular purpose.
10. Limitations:
a. TO THE MAXIMUM EXTENT PERMITTED, EACH PRIZE IS AWARDED "AS IS". SPONSOR MAKES NO WARRANTIES OF ANY KIND, INCLUDING ANY WARRANTIES OF NONINFRINGEMENT, IMPLIED OR EXPRESS WARRANTIES, OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITHOUT LIMITATION.
b. Sponsor is not responsible for any lost, damaged or interrupted Submission or any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any entry. Sponsor also is not responsible for any problems or technical malfunction of telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to your or any other person’s computer related to or resulting from participation, or downloading of any materials, in this Giveaway.
c. ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW AND TO RECOVER ALL COSTS INCURRED. Sponsor reserves the right to cancel the contest if it becomes technically corrupted and award prize entries received up until corruption and cancellation.
d. Should any portion of the Giveaway be, in Sponsor’s sole discretion, compromised by virus, worms, bugs, non-authorized intervention or other causes which, in the sole discretion of Sponsor, corrupt or impair the administration security, fairness or proper play, or submission of entries, Sponsor reserves the right to cancel, terminate, modify or suspend the Giveaway and conduct the Giveaway in a manner which in its sole discretion is fair, appropriate and consistent with these Official Rules.
11. Social Media Limitations: For any Giveaways made available through social media platforms, Participant acknowledges this Giveaway is in no way sponsored, endorsed or administered by, or associated with the social media platform providers. By participating in this Giveaway, Participant hereby releases any social media service through which the Giveaway is offered from any claim, allegation, loss or liability of any kind. Participant is limited to use of a single account for entries. Any participant found to submit multiple entries or entries through multiple accounts will be ineligible.
12. Third Party Terms: In the course of participating in the Giveaway, Participant may be required to use services and provide information to certain third parties. By participating in the Giveaway, Participant agrees to the third party privacy policies and terms and conditions as defined below (“Third Party Terms”), which are incorporated herein by reference.
