1. ARTICLE – ORGANISATION DE L’OPERATION
DELSEY (ci-après la « société organisatrice »), société anonyme, immatriculée au registre du
commerce et des sociétés sous le numéro : 572 017 507 00102 dont le siège social est situé
au 215 Avenue des Nations 95970 – ROISSY CDG France organise du 25 juillet 2012 10h00 du
matin (heure française) au 16 aout 2012 10h00 (heure française) inclus, puis du 17 aout 2012
10h00 (heure française) au 7 septembre 2012 10h00 (heure française) une opération «Take a
Trip with me» « Partez en voyage avec moi » (ci-après dénommé « l’Opération»), selon les
modalités décrites dans le présent règlement.
Ce concours sera accessible à partir du site web www.delsey.com , de la page Facebook, du
compte Twitter de DELSEY.
Toute personne participant à cette opération accepte le présent règlement.
Cette opération n’est ni organisée, ni parrainée par Facebook.
Les données personnelles collectées sont destinées à la société organisatrice et non à
Facebook.
2. ARTICLE – PARTICIPANTS
Cette opération est ouverte à toute personne physique âgée d’au moins 18 ans, disposant d’un
accès à internet ainsi que d’une adresse électronique valide, et un compte Facebook à
l’exception des personnels de la société organisatrice et de leurs familles, ainsi que de toutes
personnes ayant participé à l’élaboration de cette opération.
L’opération est ouverte à tout participant à l’exclusion des résidents des pays suivants : US,
Canada, Chine, Inde, Irlande du Nord ainsi que tout autre pays où la présente opération pourrait
être interdite ou réglementée.
3. ARTICLE – CONDITIONS DE PARTICIPATION
L’opération est limitée à une seule participation durant toute la durée de l’opération.
Le seul fait de participer à cette opération implique l'acceptation pure et simple, sans réserve,
du présent règlement.
4. ARTICLE – MODALITÉS DE PARTICIPATION
Cette opération se déroule exclusivement sur internet aux dates indiquées dans l’article 1.
Pour accéder à l’application de l’opération, cliquez sur « j’aime », puis insérez une photo et
remplissez le formulaire de participation mis à disposition des participants puis validez.
La participation devient définitive après validation par notre modérateur.
Cette opération fait appel à l’imagination, à la créativité des participants.
Il s’agit pour les participants d’interpréter à leur guise selon leurs aptitudes le thème «Take a
Trip with me », « Partez en voyage avec moi » en se mettant en scène avec leur (s) valises.
Il est expressément prévu qu’aucune marque sous quelle que forme que ce soit (logo, slogan,
….) ne devra être visible sur la photographie, sous peine d’exclusion.

Tout formulaire comportant des informations erronées, incomplètes ou inexactes sera considéré
comme nul et ne permettra pas au participant qui l’a rempli de participer à l’opération.
Les propriétés de la contribution doivent être les suivantes :
Format autorisé : .jpg et .jpeg
Poids maximum : 1,5 Mo
Il n’est autorisé qu’une seule participation par personne -même nom, même prénom, même
adresse électronique pendant toute la période de l’opération.
5. ARTICLE – DESIGNATION DES LAURÉATS
5.1 NOMBRE DE LAURÉATS
3 lauréats par session (soit 6 au total) seront désignés par les votes des internautes sur des
critères d’originalité, d’esthétisme et de maîtrise technique parmi les contributions des
participants ayant complété et validé le formulaire de participation et soumis une contribution
valide.
Le(s) participant(s) dont la contribution réunira le plus de votes à l’issue de l’opération sera(ont)
le(s) lauréat(s).
En cas d’ex-æquo, ceux-ci seront départagés par un jury composé de 3 membres de la société
organisatrice.
5.2 PUBLICATION DES RÉSULTATS
Le(s) lauréat(s) recevra(ont) un courrier électronique, à l’adresse électronique qu’il(s) aura(ont)
fournie dans le formulaire de participation, dans les 7 jours suivant la fin de chaque session de
l’opération, lui (leur) confirmant la nature du lot gagné et les modalités pour en bénéficier.
Tout lauréat ne donnant pas de réponse dans un délai de 1 mois à compter de l’envoi d’avis de
son gain sera réputé renoncer à celui-ci.
5.3 DÉROULEMENT DU VOTE
Les internautes possédant un compte Facebook pourront voter pour la photographie qu’ils
préfèrent à partir de la galerie de l’application de l’opération. Ils ne pourront voter qu’une seule
fois pour une seule photographie.
6. ARTICLE – DOTATION
Chaque session de l’opération est dotée des lots suivants, attribués aux participants désignés
lauréats.
Chaque lauréat remporte un seul lot.
Liste des lots par session de l’opération :
 Le premier lauréat : 1 valise HELIUM d'une valeur indicative de .319 euros TTC
 Le second lauréat : 1 valise U-LITE d'une valeur indicative de .209 euros TTC
 Le troisième lauréat : 1 valise PILO d’une valeur indicative de 169 euros TTC
7. ARTICLE – REMISE DES LOTS
Après avoir reçu le courrier électronique lui indiquant qu’il a été désigné comme lauréat et son
lot, le lauréat disposera d’un délai de 1 mois pour communiquer à la société organisatrice son
adresse.
Il recevra son lot dans un délai indicatif de 15 jours ouvrés à cette adresse par voie postale.

Les dotations ne pourront en aucun cas être échangées contre leur valeur en espèces ou
contre toute autre dotation. La société organisatrice ne saurait être tenue pour responsable de
l’utilisation ou de la non utilisation, voire du négoce, des lots par les lauréats.
En cas de force majeure, la société organisatrice se réserve le droit de remplacer le lot gagné
par un lot de nature et de valeur équivalente.
8. ARTICLE – IDENTIFICATION DES LAUREATS
Les participants autorisent la vérification de leur identité et de toutes les informations figurant
sur le formulaire de participation. Les participations dont le formulaire ne sera pas entièrement
rempli et/ou comportant des coordonnées incomplètes ou fausses ne seront pas prises en
considération et entraînent l’élimination de la participation. De même, le non respect du présent
règlement ainsi que toute fraude ou tentative de tricherie, quelles que soient ses modalités,
entraînera l’élimination pure et simple de la participation de son auteur.
9. ARTICLE – DIGNITE ET RESPECT DES DROITS
L’organisateur se réserve le droit d’exclure un participant si sa photographie porte atteinte à la
dignité et au respect d’autrui et/ou de ses droits, sans à avoir à justifier sa décision, s’il estime
que la photographie proposée par le participant peut être considérée comme :
- préjudiciable et/ou dévalorisant pour l’organisateur, en contradiction avec son image;
- contraire à une disposition légale ou règlementaire et notamment sans que cette liste
ne soit limitative :
- contraire aux droits des tiers et notamment à leurs droits de propriété
intellectuelle ;
- contraire à l’ordre public, à la décence et aux bonnes moeurs ;
- à caractère pornographique, érotiques ou pédophiles
- faisant l’apologie de crimes ou délits de quelque nature que ce soit
- à caractères discriminatoires, haineux ou violents à l’égard d’une personne ou
d’un groupe de personnes en raison de leur origine, de leur appartenance ou
de leur non appartenance à une ethnie, une nation, une race ou une religion
déterminée
- à caractère diffamatoire, injurieux, calomnieux ou dénigrant à l’égard de tiers,
personnes physiques ou morales
- portant atteinte à la vie privée, au droit à l’image de toute personne
- portant atteinte aux droits de propriété intellectuelle, artistique ou industrielle
d’un tiers
- et, d’une manière générale, contraire à la législation en vigueur
Tout participant ne respectant pas ces interdictions serait aussitôt éliminé de l’opération sans
préjudice des éventuelles poursuites susceptibles d'être intentées à l'encontre du participant par
la société organisatrice ou par des tiers.
Le participant garantit par ailleurs qu'il détient l'ensemble des droits et autorisations nécessaires
pour participer à cette opération, et qu'en conséquence, celui-ci ne porte pas atteinte aux droits
des tiers.
10. ARTICLE – DROIT A L’IMAGE
Les participants, en participant à cette opération, acceptent et autorisent Delsey à fixer,
enregistrer, utiliser, reproduire, dupliquer, représenter, diffuser, adapter et modifier leur image
figurant sur la photographie envoyée dans le cadre de la présente opération et acceptent que
leur image, leur prénom et leur pays de résidence soient :
- publiée sur la page Facebook de Delsey pendant une durée de 1 an.

Ces autorisations sont valables pour le monde entier. Elles sont consenties à titre gracieux et
n’ouvriront droit à aucune rémunération directe ou indirecte d’aucune sorte.
11. ARTICLE – DEPOT, ET COMMUNICATION DU REGLEMENT
Le présent règlement a été déposé auprès de l’étude de SELARL PETEY – GUERIN –
BOURGEAC, Huissiers de justice associés, 221 rue du faubourg Saint Honoré 75008
Paris
Il peut être obtenu sur simple demande à l’adresse de la société organisatrice, spécifiée à
l’article 1, pendant toute la durée de l’opération.
Le règlement est par ailleurs consultable via l’application de l’opération.
12. ARTICLE – REMBOURSEMENT DES FRAIS DE PARTICIPATION
Cette opération ne faisant aucunement appel au hasard, il est expressément convenu que tous
les éventuels frais de participation (notamment, et de façon non exhaustive, les éventuels frais
de connexion à internet, d’affranchissement, de demande d’un exemplaire du présent règlement
…) restent à la charge du participant.
13. ARTICLE – RESPONSABILITES
La participation implique la connaissance et l’acceptation des caractéristiques et des limites de
l’Internet, l’absence de protection de certaines données contre des détournements éventuels ou
piratage et risques de contamination par des éventuels virus circulant sur le réseau. La société
organisatrice décline toute responsabilité directe ou indirecte en cas de mauvaise utilisation ou
d’incident lié à l’utilisation de l’ordinateur, à l’accès à Internet, à la maintenance ou à un
dysfonctionnement des serveurs de l’opération, de la ligne téléphonique ou de toute autre
connexion technique,
Il appartient à tout participant de prendre toutes les mesures appropriées de façon à protéger
ses propres données et/ou logiciels stockés sur son équipement informatique contre toute
atteinte. La connexion de toute personne à l’application et la participation des participants à
l’opération se fait sous leur entière responsabilité. La société organisatrice se réserve le droit de
disqualifier tout participant qui altérerait le déroulement de l’inscription à l’opération et d’annuler,
écourter, modifier, reporter, proroger ou suspendre l’opération, dans le cas où les serveurs
informatiques de l’opération présenteraient des dysfonctionnements résultant notamment de
bogues, d’une altération, d’une intervention non autorisée, d’une fraude, d’anomalies
techniques ou de tout autre cause due au fait de ce participant et qui affecteraient
l’administration, la sécurité, l’équité, l’intégrité ou le bon déroulement de l’opération.
La société organisatrice ne saurait encourir une quelconque responsabilité, en cas de force
majeure ou d’événements indépendants de sa volonté si elle était amenée à annuler la
présente opération.
14. ARTICLE – DROITS DE PROPRIETE INTELLECTUELLE, LITTERAIRE ET
ARTISTIQUE
Les images utilisées sur l’application de l’opération, les objets représentés, les marques et
dénominations commerciales mentionnées, les éléments graphiques, informatiques et les bases
de données composant l’application de l’opération, sont la propriété exclusive de leurs titulaires
respectifs et ne sauraient être extraits, reproduits ou utilisés sans l'autorisation écrite de ces
derniers, sous peine de poursuites civiles et/ou pénales.
Toute ressemblance de personnages ou d'éléments de l’opération avec d'autres personnages
fictifs ou d'autres éléments de concours déjà existants, serait purement fortuite et ne pourrait
conduire à engager la responsabilité de la société organisatrice ou de ses prestataires.

Le participant affirme être l’auteur de la contribution qu’il soumet et garantit que l’oeuvre
proposée est originale et inédite. A ce titre, le participant fait son affaire des autorisations de tout
tiers ayant directement ou indirectement participé à la réalisation de la contribution (notamment
et de façon non exhaustive, à titre créatif, technique ou figuratif) et/ou qui estimerait avoir un
droit quelconque à faire valoir à son égard. Il assumera la charge de tous les éventuels
paiements en découlant. De façon générale, le participant garantit les organisateurs de
l’opération contre tout recours, action ou réclamation que pourrait former, à un titre quelconque,
tout tiers, à l’occasion de l’exercice des autorisations accordées au sein des présentes et plus
généralement au titre de toutes les garanties et engagements pris au titre du présent règlement.
Le participant s’engage à dégager les organisateurs de toute responsabilité en cas de
réclamations émanant de tiers du fait notamment d’une contrefaçon ou de la et plus
généralement de toute atteinte aux droits d’un tiers, quelle qu’en soit la nature.
Le participant cède à titre exclusif à la société organisatrice, qui l’accepte, l’intégralité des droits
de propriété intellectuelle sur les photographies réalisées.
Les droits cédés comprennent :
- le droit de reproduire, directement ou indirectement, sans limitation de nombre, en
tout ou partie la photographie, y compris le droit de stocker et d’archiver ;
- le droit de communiquer au public et de distribuer directement ou indirectement la
photographie, par tout moyen de communication et sous toute forme ;
- le droit d’adapter les photographies, directement ou indirectement, leurs apporter
toute modification, coupe ou complément, présentation nouvelle, les intégrer à
toute autre création ou produit (recueils, ouvrages, bases de données, produits
multimédia, etc.) ou les associer à tous éléments (commentaires, légendes,
textes, illustrations, etc.).
Pour l’ensemble des droits susvisés sont compris tous les modes d’exploitation connus ou
inconnus, directs ou indirects sur la page Facebook de Delsey ainsi que sur l’application de
l’opération.
La cession des droits de propriété intellectuelle est effectuée pour toute la durée légale de
protection des droits de propriété intellectuelle telle que reconnue par les lois présentes ou à
venir.
La présente cession est consentie à titre gracieux et ne donnera lieu à aucune contrepartie de
quelque nature que ce soit au profit du participant.
Les droits de propriété intellectuelle susvisés sont cédés pour le monde entier.
15. ARTICLE– DONNÉES À CARACTERE PERSONNEL
Delsey, responsable de traitement, met en oeuvre un traitement de données à caractère
personnel ayant pour finalité la gestion et l’organisation de l’opération «Take a trip with me »,
« Partez en voyage avec moi » l’attribution des lots et la communication interne et externe liée à
cette opération, la prospection notamment commerciale.
Les données collectées identifiées comme telles sont obligatoires, en leur absence votre
participation ne pourra être validée.
Ces données sont destinées aux services habilités de Delsey.
Par ailleurs, des informations (prénom, photographie…) peuvent être transférées vers les Etats
Unis à des fins notamment de stockage de la page Facebook de Delsey par Facebook Inc...
Ces transferts sont encadrés par la Décision 2000/520/CE de la Commission Européen qui

reconnait le caractère adéquat de la protection des données offerte par les sociétés adhérant
au Safe Harbor auxquels adhèrent Facebook Inc. et Twitter Inc.
Le participant dispose d’un droit d’interrogation, d’accès, de rectification, et de suppression des
données le concernant, ainsi que d’un droit d’opposition pour motifs légitimes. Si vous ne
souhaitez pas recevoir de la prospection notamment commerciale vous pouvez également vous
y opposer. L’ensemble de ces droits s’exercent par courrier électronique, avec une copie d’un
titre d’identité signé, à l’adresse électronique suivante : contact@delsey.com
16. ARTICLE – PREUVE
Les registres informatisés conservés dans les systèmes informatiques seront conservés dans
des conditions raisonnables de sécurité et considérés comme les preuves des communications,
des opérations intervenus. Elles font foi jusqu’à preuve du contraire.
L’archivage des données et documents est effectué sur un support fiable et durable pouvant
être produit à titre de preuve et dans des conditions de nature à en assurer l’intégrité.
17. ARTICLE – DROIT APPLICABLE ET JURIDICTION COMPETENTE
Le présent règlement est soumis à la loi française sans préjudice des dispositions plus
protectrices.
TOUT LITIGE QUI POURRAIT SURGIR A PROPOS DE L’EXECUTION, DE LA
VALIDITE OU DE L’INTERPRETATION DES PRESENTES, SERA PORTE DEVANT
LE TRIBUNAL DU LIEU OU EST ETABLI LE SIEGE SOCIAL DE LA SOCIETE
ORGANISATRICE, SANS PREJUDICE DES DISPOSITIONS LEGALES

1.1.1.1.1. ARTICLE – ORGANIZATION OF THE OPERATION
DELSEY (“promoter”), a “société anonyme”, registered with the Registrar of
Companies under number: 572 017 507 00102 with registered offices located at 215,
Avenue des Nations 95970 – ROISSY CDG France, is organizing from 25 July 2012
10:00a.m. (French time) to 16 August 2012 10:00a.m. (French time) included, and then
from 17 August 2012 10:00a.m. (French time) to 7 September 2012 10:00 a.m. (French
time) the operation “Take a Trip with me” (“operation”), subject to the terms and
conditions as described in these rules.
The Contest will be accessible from the DELSEY website www.delsey.com, Facebook
homepage and Twitter account.
By entering the operation you agree to these terms and conditions.
This operation is neither organized nor sponsored by Facebook.
The personal data collected is intended for the promoter and not for Facebook.
1.1.1.1.2.ARTICLE – ENTRANTS
This operation is open to any individual who is at least 18 of age, with access to the
internet, a valid email address and a Facebook account. Staff members of the promoter
and their families as well as any individuals having participated in the elaboration of this
operation are not eligible for entry.
The operation is open to all entrants except residents of the following countries: U.S.,
Canada, China, India, North Ireland and any other countries where this operation could
be prohibited or regulated.
1.1.1.1.3.ARTICLE – CONDITIONS FOR ENTRY
The operation is limited to one entry throughout the duration of the operation.
By entering this competition, you fully and unconditionally agree to these terms and
conditions.

This operation is made exclusively on the Internet on the dates indicated in article 1.
To access the application of the operation, click on “I like” and then insert a photo,
complete and submit the entry form made available for entrants.
Entry becomes final after validation by our moderator.
This operation is based on the imagination, creativity of the entrants.
Entrants have to interpret, as they wish, according to their skills, the theme “Take a Trip
with me”, by featuring themselves with their luggage.
It is expressly provided that no trademark, in any form whatsoever, (logo, slogan...)
should be visible on the photograph; otherwise, the entrant will be disqualified.

Any entry form containing inaccurate, incomplete or inexact data will be considered
void and will disqualify the entrant who has completed it from the operation.
The contribution must meet the following criteria:
Authorized format: .jpg and .jpeg
Maximum size: 1.5 Mo
Only one entry per person is allowed -same last name, same first name, same email
address throughout the duration of the operation.
1.1.1.1.5.ARTICLE – DESIGNATION OF WINNERS
5.1 NUMBER OF WINNERS
3 winners per session (i.e. 6 in total) will be designated by the votes of Internet users
based on criteria related to originality, esthetic qualities and technical mastery among
the contributions of the entrants having completed and submitted an entry form and
submitted a valid contribution.
The entrant(s) whose contribution will receive the largest number of votes at the end of
the operation will be the winner(s).
In case of a tie, a jury made of 3 members of the promoter will decide between
entrants.
5.2 PUBLICATION OF RESULTS
Winner(s) will receive an email, at the email address they have provided in the entry
form, within 7 days after the end of each operation session, confirming the nature of the
prize won and the procedure to obtain it.
If a winner fails to answer within 1 month after the sending of the notification of the
prize, he/she will be deemed as having waived the prize.
5.3 VOTING PROCESS
Internet users with a Facebook account may vote for the photograph they prefer from
the gallery of the application of the operation. They can only vote once for one single
photograph.
1.1.1.1.6.ARTICLE – PRIZES
Each session of the operation involves the following prizes, which will be assigned to
the entrants designated winners.
Each winner only gets one prize.
List of the prizes per session of the operation:
- Grand-prize winner: 1 HELIUM suitcase of an indicative value of 319 euros all
taxes included
- Second-place winner: 1 U-LITE suitcase of an indicative value of 209 euros all
taxes included
- Third-place winner: 1 PILO suitcase of an indicative value of 169 euros all taxes
included

1.1.1.1.7.ARTICLE – DELIVERY OF PRIZES
After having received the email notifying him/her of his/her designation as winner and
of his/her prize, the winner will have one month to communicate his/her address to the
promoter.
The winner will receive his/her prize by mail within an indicative period of 15 business
days.
Prizes may under no circumstances be exchanged against their value in cash or any
other prize. The promoter is not liable for the use or non-use, or the sale, of the prizes
by the winners.
In case of force majeure, the promoter reserves the right to replace the prize won by
another prize of an equivalent nature and value.
1.1.1.1.8.ARTICLE – IDENTIFICATION OF WINNERS
Entrants authorize the verification of their identity and any information provided in the
entry form. Entry forms not completed and/or containing incomplete or false data will
not be taken into account and will result in a disqualification. Similarly, the noncompliance
with these rules and any fraud or attempt to fraud, in any manner
whatsoever, will result in the automatic disqualification of the entrant.
1.1.1.1.9.ARTICLE – DIGNITY AND COMPLIANCE WITH RIGHTS
The promoter reserves the right to exclude an entrant if his/her photograph affects
dignity and other persons and/or the rights of other persons, without having to justify its
decision, if it deems that the photograph proposed by the entrant may be regarded as:
- harmful and/or damaging for the promoter, in contradiction with its image;
- contrary to a statutory or regulatory provision, such as in cases including but not
limited to:
- contrary to rights of third party and in particular their intellectual property rights;
- contrary to public policy, decency and morality;
- of a pornographic, erotic or pedophile nature;
- promoting crimes or offences of any nature
- of a discriminatory, hatred or violent nature against a person or group of
persons due to their origin, belonging or non-belonging to a specific ethnic
group, nation, race or religion
- of a defamatory, abusive, calumnious or denigrating nature towards third
parties, whether individuals or legal entities
- infringing the privacy, the right of personal portrayal of anyone
- infringing the intellectual, artistic or industrial property rights of a third party
- and generally contrary to applicable laws
Any entrant violating the above prohibitions will be immediately disqualified without
prejudice to any other action that may be taken against him/her by the promoter or third
parties.
The entrant also guarantees that he/she holds all rights and authorizations required to
participate in this operation, and as a result that he/she does not infringe the rights of
third parties.
1.1.1.1.10.ARTICLE –RIGHT OF PERSONAL PORTRAYAL
The entrants, by participating in this operation, agree and authorize Delsey to fix,
record, use reproduce, duplicate, represent, diffuse, adapt and modify their image

appearing on the photograph sent for this operation and agree that their image, first
name and country of living be:
- published on the Facebook homepage of Delsey for 1 year.
Those authorizations are valid worldwide. They are granted for free and will not give
rise to any direct or indirect compensation of any nature whatsoever.
1.1.1.1.11.ARTICLE – REGISTRATION AND COMMUNICATION OF THE RULES
These rules have been registered with the office of SELARL PETEY – GUERIN –
BOURGEAC, Huissiers de justice associés, 221 rue du faubourg Saint Honoré 75008
Paris
They can be obtained upon request sent at the address of the promoter, as specified in
article 1, throughout the duration of the operation.
The rules can also be consulted via the application of the operation.
1.1.1.1.12.ARTICLE – REFUND OF THE ENTRY FEE
This operation is not based on chance and it is expressly agreed that any entry fees
(including, but not limited to Internet connection fees, postage, request to obtain a copy
of these rules…) are to be paid by the entrant.
1.1.1.1.13. ARTICLE – LIABILITY
Entry implies the knowledge and acceptance of the characteristics and limits of the
Internet, the absence of protection of some data against possible diversions or piracy
and risks of contamination by any virus circulating on the network. The promoter
assumes no liability, whether direct or indirect, in case of misuse or incident linked to
the use of the computer, Internet access, maintenance or malfunction of the servers of
the operation, telephone line or any other technical connection.
It is the responsibility of the entrant to take appropriate measures to protect his/her own
data and/or software stored on his/her hardware against any damage. The connection
of any person on the application and the participation of the entrants in the operation
are made under their own responsibility. The promoter reserves the right to disqualify
any entrant who would alter the operation of the registration to the operation and
cancel, shorten, modify, postpone, extend or otherwise discontinue the operation, in the
event where the IT servers of the operation would present malfunctions arising out of in
particular bugs, alteration, unauthorized intervention, fraud, technical anomalies or any
other cause resulting from such entrant and that would affect the administration,
security, fairness, integrity or proper functioning of the operation.
The promoter shall not be liable in case of force majeure or events beyond its control
leading it to cancel this operation.
1.1.1.1.14.ARTICLE – INTELLECTUAL, LITERARY AND ARTISTIC PROPERTY
RIGHTS
The images used on the application of the operation, the objects represented, the
trademarks and commercial denominations mentioned, the graphic and IT elements,
the databases composing the application of the operation are the exclusive property of
their respective owners and may not be extracted, reproduced or otherwise used
without their written authorization; any breach of the foregoing will be subject to civil
and/or criminal actions.

Any resemblance to persons or elements of the operation with other fictional persons
or other elements of already existing contests is purely coincidental and the promoter
or its providers may not be held liable therefor.
The entrant affirms that he/she is the author of the contribution he/she submits and
warrants that the work proposed is original and unpublished. To this end, the entrant
shall be responsible for obtaining any authorization required from third parties who
have directly or indirectly participated in the creation of the contribution (including,
without limitation, on a creative, technical or walk-on basis) and/or who would deem to
have any right therein. The entrant shall pay any sums that would arise out of or be
related to the foregoing. Generally, the entrant indemnifies and holds the organizers of
the operation harmless from and against any claim, action or suit that be made, for any
reason whatsoever, by a third party under the exercise of the authorizations granted in
these rules and more generally under the warranties and undertakings made in these
rules.
The entrant undertakes to hold the promoters harmless from and against any claims
made by a third party who would in particular allege a counterfeit or more generally any
infringement of rights, of any nature whatsoever.
The entrant assigns on an exclusive basis to the promoter, which accepts, all of the
intellectual property rights in and to the photographs made.
The rights assigned include:
- the right to reproduce, directly or indirectly, without limitation as to number, all or
part of the photograph, including the right to store and archive;
- the right to communicate to the public and distribute the photograph, directly or
indirectly, by any means of communication and in any form;
- the right to adapt the photographs, directly or indirectly, to modify, cut or
complete them, give them a new presentation, integrate them into any other
creation or product (collections, books, databases, multimedia products etc.) or
combine them with any elements (comments, legends, texts, illustrations, etc.).
All the above rights include all methods of exploitation, known or unknown, direct or
indirect, on the Facebook page of Delsey as well as on the application of the operation.
The assignment of intellectual property rights is made for the duration of the legal
protection of intellectual property rights such as recognized by current or future laws.
This assignment is granted on a free-of-charge basis and will not give rise to any
compensation, of any nature whatsoever, for the entrant.
The above mentioned intellectual property rights are assigned on a worldwide basis.
1.1.1.1.15.ARTICLE– PERSONAL DATA
Delsey, as data controller, implements processing of personal data with the purpose of
managing and organizing the operation “Take a trip with me”, assigning prizes and
ensuring the internal and external communication related to this operation, such as
direct marketing.
The data collected identified as mandatory must be provided; if you do not provide
such data, your participation may not be validated.
The data is intended for the relevant departments of Delsey.

In addition, information (first name, photograph…) may be transferred to the USA in
particular for the purposes of storing the Facebook homepage of Delsey by Facebook
Inc... Those transfers are regulated by the Decision 2000/520/EC of the European
Commission that recognized the adequate level of protection of data ensured by
companies that have joined the Safe Harbor such as Facebook Inc. and Twitter Inc.
The entrant has a right to inquire about, access, rectify and suppress the data about
him/her as well as a right to object to their processing on legitimate grounds. If you do
not wish to receive commercial messages, in particular direct marketing messages, you
can also express your objection. You can exercise all of the foregoing rights by sending
an email, together with copy of an identity document bearing your signature, at the
following email address: contact@delsey.com
1.1.1.1.16.ARTICLE – EVIDENCE
The computerized registers stored in the computer systems are stored in reasonable
security conditions and shall be regarded as evidence of the communications and
operations made. They shall be deemed authentic until proven otherwise.
The data and documents are archived on a reliable and durable medium that may be
produced as evidence and in conditions likely to guarantee their integrity.
17.ARTICLE – GOVERNING LAW AND COMPETENT JURISDICTION
These rules are governed by French law, without prejudice to more protective
provisions.
ALL DISPUTES THAT MAY ARISE ABOUT PERFORMANCE, VALIDITY OR
INTERPRETATION OF THE RULES, SHALL BE SUBMITTED TO THE COURT
WHERE THE PROMOTER HAS ITS REGISTERED OFFICE NOTWITHSTANDING
THE APPLICABLE LAW WHICH WOULD DESIGNATE ANOTHER JURISDICTION.
