CONTEST RULES • DYNASTAR / COMPAGNIE DU MONT BLANC
ARTICLE 1 : SUMMARY
SKIS ROSSIGNOL SAS • 98 rue Louis Barran • 38430 St Jean de Moirans • FRANCE hereby organises in partnership with LA COMPAGNIE DU MONT BLANC – 35, place de la Mer de glace – 74400 CHAMONIX - FRANCE(hereafter “the organisers”) a contest from 21 December 2016 to 13 March 2016 for the purpose of holding a random draw among the persons registered according to these rules. The contest can be accessed via twenty iPads made available in the CHAMONIX MONT BLANC ski resort, two computers made available on the DYNASTAR test ski stands and via the website www.chamonix.dynastar.com. Entry is free with no obligation to purchase and is open to anyone except employees of Rossignol Group companies. The contest is subject to French law. Minors must demonstrate that they have parental consent to enter the contest.
ARTICLE 2 : DURATION
The contest will be open from 21 December 2015 to midnight (French time) on 13 March 2016.
ARTICLE 3 : OPERATION OF THE CONTEST
To enter the contest, participants must either: • find an iPad among the twenty iPads made available throughout the CHAMONIX MONT BLANC ski resort (in sports shops, hotels, restaurants, at ski lift stations), or • go to the DYNASTAR test ski stands where two computers will be made available, or • visit the website www.dynastar.com. The participant must then: •Enter the following personal information: •first name • last name • Email • Country • Tick the box «I have read and accept the rules» • Click on «I participate,» which will automatically result in the participant s agreement to subscribe to the DYNASTAR and LA COMPAGNIE DU MONT BLANC newsletters. However, the participant may decline to subscribe to these newsletters by ticking the box I would like to participate without subscribing to the DYNASTAR and LA COMPAGNIE DU MONT BLANC newsletters.
Each participant must provide his complete contact details on the electronic entry form: email address, country, and have ticked the acceptance of the contest rules. If participants enter an invalid, illegible, or incomplete email address and•or fail to tick the contest rules acceptance box, they will be automatically disqualified from participating, at the sole discretion of the organisers. DRAW On 15 march 2016, thirteen participants will be drawn at random, corresponding to one winner per week throughout the duration of the contest. SKIS ROSSIGNOL will use a software program to conduct the random draw among all participants who have registered since the contest start date.
ARTICLE 4 : TERMS OF PARTICIPATION IN THE CONTEST
Participants must follow the instructions described in clause 3 to be eligible to enter the contest. Participation is limited to one email address per person. Any entry form which is incomplete, does not comply with these rules or includes illegible email addresses will be considered null and void. Fraud The organisers reserve the right to modify, postpone or cancel the whole or any part of the contest if it appears that there has been fraud of any kind, especially electronic fraud, in the course of participation in the contest or the selection of winners. In that event, they reserve the right to not award prizes to those responsible for such fraud and/or to bring legal action against them before the competent courts. Nonetheless, the organisers cannot be held liable in any way whatsoever vis-à-vis the participants for any fraud that may be committed.
ARTICLE 5 : PUBLICATION OF RESULTS
The names of the winners of the random draw will be announced to the public on the Facebook pages of LA COMPAGNIE DU MONT BLANC and DYNASTAR. Furthermore, SKIS ROSSIGNOL will contact the winners directly, by email. Upon receiving this email, the winners undertake to inform SKIS ROSSIGNOL of their last names, first names and postal addresses within 30 days. Failing this, the gifts will be automatically returned to the draw.
ARTICLE 6 : PRIZES
Contest winners will receive the following prizes: • A pair of skis chosen among the Powertrack 89 fluid-x and Cham 2.0 97, with a suggested retail price of 699,99 euros, all taxes included. • A one-week ski pass in the CHAMONIX MONT BLANC ski resort, valued at 246 euros, all taxes included, excluding transportation, accommodation and meals. The winners will be responsible for all applicable duties and taxes. The organisers will not replace prizes by means of substitution, transfer or cash payment. In the event a prize is unavailable, a prize of equivalent or higher value will be awarded. The organisers may alter the contest prize structure without giving reasons, and cannot be held liable for any loss caused by such alteration. However, in this event the winner will be offered another prize of equivalent value. No party may hold or seek to hold the organisers liable if, following an event of force majeure or exceptional circumstances, changes are made to how the contest is run or the organisers are obliged to suspend or postpone the contest or cancel it altogether.
ARTICLE 7 : AWARD OF PRIZES
Prizes will be sent, via the postal service or any other transport company, to the winner's home address within 90 days of the end of the contest. The organisers cannot be held liable in the event the letter and the prizes are not delivered or delivered incorrectly by the postal service or by any other transport company. The winner will not be entitled to request the exchange, replacement or a cash equivalent in place of the prize for any reason whatsoever.
ARTICLE 8 : ACCEPTANCE OF THE CONTEST RULES
The simple fact of participating in this contest implies your complete acceptance of these rules. SKIS ROSSIGNOL reserves the right to cut short, prolong, modify or cancel the contest, if circumstances so require. It shall incur no liability as a result of this. The same shall apply in the case of fraud of any kind, including electronic fraud, during the course of participating in the contest or selecting the winners. In such a case SKIS ROSSIGNOL reserves the right to not award prizes to those responsible for the fraud, and to exclude any participant whose conduct is suspected of being fraudulent, without prior warning. The organisers reserve the right, in relation to any person distorting the operation of the contest, or interfering with its administration, security, fairness, integrity or proper operation, to withdraw his or her right to participate in the contest, either temporarily or permanently, and where applicable to bring legal proceedings against him.
ARTICLE 9 : GENERAL INFORMATION
SKIS ROSSIGNOL reminds participants of the nature and limitations of the Internet and may be held liable for any consequences of accessing the Internet. SKIS ROSSIGNOL cannot be held liable for any difficulties downloading, uploading or delivering email, under any circumstances. More specifically, SKIS ROSSIGNOL cannot be held liable for any physical or consequential damage caused to participants, their IT equipment or the data stored therein, or for any consequences for their personal or business activities. Furthermore, SKIS ROSSIGNOL cannot be held liable in the event that one or more participants are unable to access http://www.langeskiboots.com/ or to participate in the contest as a result of any technical fault or other difficulty (including network congestion).
ARTICLE 10: DATA PROTECTION
The organisers may use personally identifiable data collected during registration for the contest for promotional purposes, and in particular when sending newsletters, product information and the like, which participants expressly accept. Nonetheless, pursuant to article 27 of the French data protection law of 6 January 1978, participants have the right to access, correct and delete their personally identifiable information.
