Terms and Contions of the contest

THE UNDERSIGNED COMPANY EBERHARD & CO. S.A.. HEADQUARTERED AT BIENNE – RUE DU MANÈGE, 5 – CH 2500 - ANNOUNCES THE PRIZE DRAW CONTEST “BE YOUR INSTANT by Eberhard & Co.”
1. Eligibility
The “BE YOUR INSTANT by Eberhard & Co.” Prize Draw Competition (the “Prize Draw”) is only open to individuals who are at least eighteen (18) years of age or the age of majority (if higher than 18) attributed by the courts of their respective country of residence. Employees of Eberhard & Co. S.A., subsidiaries or other companies related to the Prize Draw, as well as their immediate relatives (spouses, parents, siblings and children) and cohabiting partners of employees are not eligible to take part.
2. Acceptance of the Terms and Conditions
Participation in the Prize Draw implies the total and unconditional agreement and acceptance of these Official Terms and Conditions and the final and binding decisions of Eberhard & Co. Winning a prize is subject to compliance with the requirements specified herein.
3. Period of the Contest and Draws
The contest shall begin at 2 p.m. (Swiss time) on 8 June 2017 and shall end at 6 pm on 28 September 2017 (the “Competition Period”). Participating entries made before or after the Competition Period will not be considered.
There will be 5 draws:
4 monthly draws with 4 Eberhard & Co. trolleys as prizes and a final draw with a prize of a Tazio Nuvolari Desk-clock. For each draw, Eberhard & Co. will select one (1) winner by a random draw from all entries received during the relevant draw period. The odds of being selected are related to the number of entries received during the draw period. Eberhard & Co. will make every effort to notify the winner the day after the draw. If it is unable to contact the winner within ten (10) days from the first notification attempt, Eberhard & Co. will select another potential winner instead, by randomly drawing one from the remaining eligible entries received for the same draw period.
MONTHLY DRAW ON June 29th, 2017: users who register to participate in the competition between June 8th and 6 pm on June 29th will be entered in the draw. The winner will be notified on June 30th, 2017.
MONTHLY DRAW ON July 27th, 2017: users who register to participate in the competition between June 29th (with registration after 6 pm) and 6 pm on July 27,2017 will be entered in the draw. The winner will be notified on July 28th, 2017.
MONTHLY DRAW ON August 28th, 2017: users who register to participate in the competition between July 27th, 2017 (with registration after 6 pm) and 6 pm on August 28th will be entered in the draw. The winner will be notified on August 29th, 2017.
MONTHLY DRAW ON September 28th, 2017: users who register to participate in the competition between August 28th (with registration after 6 pm) and 6 pm on September 28th, the closing time for entering the competition, will be entered in the draw. The winner will be notified on September 29th, 2017.
FINAL GENERAL DRAW ON September 29th,2017: all users registered for the competition will be entered in the draw. The winner will be notified on September 29th,2017.
4. Conditions
The contest is being held as a way to celebrate the 130th anniversary of Eberhard & Co. Users have to register on the site www.eberhard-co-watches.ch during the Competition Period, fill in the online entry form and upload their contribution (photo or text) following the procedure as set out on the site. Only one (1) entry per person and email address is permitted. Users are required to represent or reinterpret something that happened during the time period from 1887 to 2017, to celebrate the company’s 130th anniversary. Users have to identify their event and place it on a date between 1887 and 2017 that they consider significant; then they have to describe it in a few words, upload an image or select one of the icons available. (E.g. “2007, my son was born...”). Contributions can be shared on social networks. There are no theme or interpretation constraints, with the exception of images depicting watches of other brands. Images with insulting or offensive content, or which offend public decency or the law will not be accepted. For these reasons, the content will only be published after approval by Eberhard & Co., within 48 hours of registration. All contents received between July 29, 2017 and August 13, 2017 will be published starting from August 14, 2017, after approval by Eberhard & Co.
5. Protection of Privacy
By participating in the Prize Draw you consent to the transfer of your personal data for the purposes of management of the Prize Draw. All data provided to Eberhard & Co. as part of this Prize Draw shall be treated according to the Federal Law on Data Protection (LPD). The personal data are intended for the exclusive use of Eberhard & Co. and shall not be disclosed to third parties.
6. Advertising:
The competition shall be advertised through the internet and the press.
7. Competent court
Any disputes concerning the application of this Rule and/or the Competition that cannot be resolved amicably shall be submitted to the exclusive competence of the Court of Lugano with the application of Swiss law.
8. Sundry
The promoting company reserves the right to ask the winners and, where applicable, the participants for any documents required to verify the correctness of the data and the contribution sent. The promoting company reserves the right to publish the contributions and the winners' data. Prizes shall be given within 30 days from the date of the draw. Participation implies the total and unconditional acceptance of the rules and the provisions herein without limitation. By entering the competition, users guarantee that they have all the rights to dispose of the contributions sent. The following contributions will not be admitted to the competition (or will be eliminated): contributions that are clearly contrary to the law, are distasteful or have content that is vulgar, obscene or offensive to current morality or that in any way adversely affects the feelings of others; have racist content or incite hatred or violence or contain false, inaccurate, misleading or fraudulent information; require or imply recompense; violate the rights of others in any way, including with regard to copyright; constitute a form of direct or indirect advertising for any commercial or profit-making activity or concern materials relating to a theme other than the one proposed. All participants agree to give the promoting company all rights, free of charge and without exception, relating to the use of the contributions sent, in all fora and through any technical means, throughout the world and for the maximum period provided by applicable copyright legislation, pursuant to and for the purposes of the transfer of rights provided for in this Rule. Rights are granted with regard to the possible publication of contributions without anything being due from the promoting company. In this respect, participants shall guarantee and indemnify the promoting company with regard to said rights to the fullest extent possible in respect of any claim made by third parties. Contributions must not contain any material having the nature or purpose of direct, indirect or subliminal advertising or that may damage the personal or property rights of third parties or that infringe on rules and regulations. The promoting company shall assume no liability for problems of access, impediment, malfunction or difficulties with regard to technical tools, computers, telephone lines, cables, electronics, software and hardware, transmission and connection, the internet, errors in postal deliveries or any other manner of causes that are beyond the control of said promoting company. No prize shall be awarded to any users who, at the sole discretion of the promoting company or third-party companies appointed by it, are considered to have won through the use of tools and instruments in a suspicious or fraudulent manner, or in violation of the normal conduct of the activity. The promoting company or third parties appointed by it reserve the right, subject to the terms deemed most appropriate and in compliance with applicable laws, to limit and prevent any initiative designed to circumvent the system. Prizes are not exchangeable or redeemable for cash, nor do they give the winners any powers to request, with or without the addition of sums of money, the possibility of receiving a different prize.
