Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. OPEN TO RESIDENTS OF THE UNITED STATES EXCEPT RESIDENTS OF NY, FL AND PUERTO RICO, AND THE FOLLOWING MEMBER STATES OF THE EUROPEAN UNION; AUSTRIA, BELGIUM, BULGARIA, CYPRUS, CZECH REPUBLIC, DENMARK, ESTONIA, FINLAND, FRANCE, GERMANY, GREECE, HUNGARY, IRELAND, LATVIA, LITHUANIA, LUXEMBOURG, MALTA, NETHERLANDS, POLAND, PORTUGAL, ROMANIA, SLOVAKIA, SLOVENIA, SPAIN, SWEDEN, UNITED KINGDOM, ALL SUBJECT TO THE LIMITATIONS DESCRIBED BELOW. VOID WHERE PROHIBITED BY LAW. The FORZIERI Contest (the "Sweepstakes") begins at 8:01 a.m. E.S.T. (US), on November 10th, 2009 and ends at 11 p.m. E.S.T. (US) on January 15th, 2010. The contest is executed by FORZIERI/Firenze Seta SRL ("FORZIERI"). The prizing sponsor is Ciga Gestioni SRL ("Prizing Sponsor"). The Prizing Sponsor is not the administrator of the Sweepsakes and is not responsible for any aspect of the Sweepstakes other than fulfillment of the Grand Prize Stay (defined below), subject to the terms and conditions set forth below. Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to, and acceptance of, these official rules and the decisions of FORZIERI, which are final.
How to Enter and Eligibility: Subject to the limitations described below, natural persons at least 18 years of age at the time of entry who are legal residents of the United States or a Member State of the European Union may enter the Sweepstakes online at www.FORZIERI.com (the "Site") by completing the online entry form in its entirety and clicking on the "Submit" button. Entries must be received by 11 p.m. E.S.T. (US) on January 15th, 2010. FORZIERI is not responsible for, and shall not be liable for, late, lost, damaged, misdirected, illegible or incomplete entries, failure or malfunction in electronics, hardware, software, communications or security or unsuccessful efforts to notify winner. If dispute over online entry arises, entry will be deemed submitted by authorized e-mail account holder. All entries become exclusive property of FORZIERI and will not be acknowledged or returned. Employees, officers and directors of FORZIERI, Prizing Sponsor, and their respective parent companies, affiliates, owners, distributors, retailers and advertising/promotion agencies, and members of the immediate family (spouses, parents, children, siblings and their respective spouses) and those whith whom they are domiciled are not eligible.
Prize and Winner: One (1) winner will receive the following prize (collectively, the "Prize")::
A three (3) night stay for two (2) people in a suite room (double occupancy) at The St. Regis Grand Hotel, located in Via Vittorio E. Orlando 3, 00185 Rome, Italy, inclusive of all residency taxes, and buffet breakfast for two (2) persons at the hotel's restaurant on each day of the stay (the "Grand Prize Stay"); PLUS 5000 EUR value Forzieri gifts of the winner's choice (the "Grand Prize Gifts").
Terms and Conditions of Grand Prize Stay: Grand Prize Stay shall be fulfilled by Prizing Sponsor, an affiliate of Starwood Hotels & Resorts Worldwide, Inc. ("Starwood"), subject to these terms and conditions. The winner must complete the Grand Prize Stay during the period commencing on February 5, 2010 to June 30, 2010 (the "Redemption Period") or prize will be forfeited. The stay must be booked at least twenty-one (21) days prior to departure. The stay is subject to availability and blackout dates. No refund or compensation will be made in the event of the cancellation or delay due to travel plans. Accommodations are subject to availability. All expenses and incidental travel costs not expressly stated in the Grand Prize Stay, including but not limited to, airfare, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Unless child of the winner, travel companion must be eighteen (18) years of age or older as of the date of departure. If winner is a minor in his/her jurisdiction of residence, travel companion must be winner's parent/legal guardian. Travel companion must execute liability/publicity releases prior to or upon arrival. Winner and travel companion are solely responsible for obtaining valid travel documentation, including passports and/or visas, and any other documents necessary for international travel. Prizing Sponsor will not replace any lost, mutilated, or stolen vouchers or certificates in respect of the Grand Prize Stay. Prizing Sponsor is responsible for the approximate retail value of the Grand Prize Stay: total of EUR 8000. Actual value may vary. Winner will not receive difference between actual and approximate retail value. Odds of winning the Grand Prize Stay shall depend on the number of eligible entries received during the Promotion Period. No cash redemption, substitution or transfer of the Grand Prize Stay is allowed, except by Prizing Sponsor in its sole discretion.
Terms and Conditions of Grand Prize Gifts: Grand Prize Stay shall be fulfilled by FORZIERI. FORZIERI is responsible for the approximate retail value of the Grand Prize Gifts: total of EUR 5000. FORZIERI shall deliver the Grand Prize Gifts (by gift voucher or otherwise) to the winner directly, and Prizing Sponsor shall have no responsibility to winner to provide or deliver the Grand Prize Gifts.
Selection of the Winner: The Prize winner will be selected in a random drawing on or about January 15th, 2010 (the "Draw Date") from all valid entries. Prizes are not transferable, exchangeable or redeemable for cash. Winners will be notified by e-mail and/or telephone within thirty (30) days of drawing. Winners must sign and return within fifteen (15) days of receipt from FORZIERI an affidavit of eligibility and liability/publicity release (including agreement to allow FORZIERI to use his or her name, voice and/or likeness for advertising, trade or promotion, without further compensation, unless prohibited by law) or an alternate winner will be selected. FORZIERI reserves the right, in its sole discretion, to suspend or cancel Sweepstakes at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper play of the Sweepstakes. By participating in the Sweepstakes, each participant agrees to release and hold each of FORZIERI and Prizing Sponsor, and their respective parent companies, subsidiaries, employees, officers, directors, shareholders, agents, representatives, affiliates, advertising and promotion agencies and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Sweepstakes or resulting from acceptance, possess, or use of the Prize, including, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. All National, federal, state/provincial and local taxes not listed in prize are sole responsibility of the winners.
Publicity: Except where prohibited by applicable law, participation in the Sweepstakes constitutes entrant's consent to the use of his/her name, picture, likeness, voice, opinions, biographical information, hometown and for promotional purposes in any media without further payment or consideration. This consent is expressly given to each of FORZIERI and Prizing Sponsor.
Non-endorsement: The use of any trademarks, service marks, logos or other marks in connection with the Sweepstakes, other than those of FORZIERI, is not meant to imply the endorsement of the respective owner(s) of such marks, or any affiliation of the respective owner(s) of such marks with the Site or the Sweepstakes.
Disputes: The Sweepstakes is governed by the laws of England. Except where prohibited, participants agree that all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with the Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively, by the courts of England. By participating, a participant submits to the jurisdiction of the English courts located in London, England.
