Entry Period.
The “Art of Custom” Contest commences on 1st March 2012 and ends at 11:59:59 p.m. (GMT) on 30th April, 2012. All entries must be received by 11:59:59 (CT) on April 30th, 2012 (Deadline). Harley-Davidson Europe Ltd (“Sponsor”), at its own discretion, may extend the period of time for the submittal of entries. Any extension of time for the submittal of entries will be posted on the contest webpage at www.harley-davidson.com
Eligibility.
The Contest is open to everyone, except Employees of Sponsor or their immediate families, who are not eligible to be entered into the Contest. Immediate family includes parents, spouse, children, siblings, grandparents, step parents, step children, and step siblings. By participating in the Contest, Entrants agree to be bound by these Official Contest Rules, release Harley-Davidson and any affiliates against all claims, injuries, or damage arising out of any participation in these Contest and redemption of the prize, and acknowledge compliance with these Official Contest Rules.
Contest Overview and Prize Information.
The 50 most “LIKED” designs on the site will be entered into consideration by the judging panel. The panel will then select 10 designs which will go forward into a final public vote. One (1) Grand Prize Winner (“Winner”), with the highest number of votes at 11:59:59 on the 31st of May 2012 will receive one (1) Harley-Davidson Sportster motorcycle displaying their winning design (“Prize”).
No substitution or transfer of prize will be accepted without Harley-Davidson’s approval or where required by law. Harley-Davidson may reward alternate prize of equal or greater value if the main components of prize become unavailable. Prize is not redeemable for cash.
How to Enter.
To enter, visit the Art of Custom page on the Harley-Davidson website. Each submission shall be in the Entrants original work and ideas, and will not be accepted or eligible if they include any content that contains or appears to contain:
Explicitly profane or obscene material;
Endorsements (or condones) illegal drug use, alcohol abuse or other illegal activity;
Nudity, profanity or extreme or gratuitous violence; language will be evaluated by Harley-Davidson based on context or societal acceptability;
Any express or implied commercial endorsement;
Any derogatory characterization of any person or group based on age race, colour, gender, gender identity and expression, sexual orientation, religious beliefs, marital status, mental or physical disability, citizenship, creed, national origin, physical appearance political affiliation, union membership or other unethical or unlawful factors;
Descriptions of any conduct, language or other context deemed inappropriate by Harley-Davidson or any of the judges; and
Any real or perceived copying or infringement of another’s intellectual property rights.
Conditions of Participation:
By entering, Entrants agree to defend and indemnify Harley-Davidson’s and Harley-Davidson’s principals subsidiaries, affiliates, directors, officers employees and agents from any and all liability for any injuries loss or damage of any kind arising from or in connection with the contest or receipt or use and/or misuse of any prize. Each Entrant agrees that Harley-Davidson may retain a copy of the submitted design and releases Harley-Davidson from liability for any loss or damage thereto. Each Entrant by submitting the design to us, also consents, approves and authorizes Harley-Davidson the right to use, broadcast, webcast, podcast, link to or from, syndicate, or otherwise exhibit or display the submitted design in its original or an altered form or format.
Conditions and Limitations of Liability:
Entries and other submitted material become the property of Harley-Davidson and will not be acknowledged or returned. By submitting an entry: (a) Entrant agrees that entry shall be a “work made for hire,” with all rights therein, including, without limitation, the exclusive copyright, being the property of Harley-Davidson; and (b) in the event Entrants submission is considered not to be a “work made for hire,” Entrant irrevocably assign to Harley-Davidson all right, title, and interest in Entrant’s submission/entry (including, without limitation, the copyright) in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all uses thereof, including, without limitation, for purposes of advertising or trade.
By entering their name into the Contest, Entrants agree to be bound by these Official Contest Rules and to release and hold harmless Harley-Davidson Motorcycle Company. and its respective subsidiary or affiliated companies from and against any and all claims or actions of any kind, whether under contract, tort, or any other legal theory, and agree to indemnify Harley-Davidson against any liability or expense arising in connection with the foregoing. Harley-Davidson reserves the right to cancel, suspend or modify the Contest or any part of it, within its sole discretion.
Except where prohibited by law, by entering the Contest, Entrants also authorize Harley-Davidson to use their name, voice, likeness, photograph, video, and city of residence, and submission/entry and written or oral statements in promotional material without compensation. Entrant shall have no right of approval, no claim to compensation, and no claim (including without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alternation, or use in composite form of your name, picture likeness, city of address or entry. The rights granted under this paragraph shall extend to Harley-Davidson and its affiliated companies with respect to all Entrants in the Contest, including those Entrants who are selected as Winner and those Entrants who are not selected as Winner. Harley-Davidson is under no obligation to use the winning Entries for any purpose.
Original Work of Authorship:
Entrant hereby warrants and represents that (a) he owns all rights to all entries and other materials submitted to Sponsor and (b) all such entries and other materials are original works of authorship on entrants part and have not been copied, in whole or in part, from any other work and do not violate, misappropriate or infringe any copyright, trademark or other proprietary right of any other person or entity.
General Information:
Harley-Davidson assumes no responsibility for entries that may be incorrectly entered or inaccurate whether cause by equipment/computer or by any human, mechanical, or electronic error which may occur in the processing of the Contest entries. Harley-Davidson reserves the right to disqualify any individual suspected or found to have used software generated, robotic, programmed, script, macro, or other automated online or text entry, anyone having tampered with the entry process, anyone to be acting in violation of these Official Contest Rules, or anyone whom has provide inaccurate information in their entry form. Harley-Davidson reserves the right to void entries it deems associated with electronic or non-electronic tampering.
