CONTEST RULES & REGULATIONS
The ‘HUGO Create’ Challenge is open to Entrants over 18 years old. Entering the Challenge is free of charge. Each participant can submit max. 5 proposals per round.
The proposals must be submitted electronically via the ‘HUGO Create’ Challenge web page located at www.hugocreate.com
The final deadline for the entry is December 31, 2009.
All proposals must contain: the name, city, country and e-mail address of the Entrant.
There is no purchase necessary to enter or win the Challenge. By entering the Challenge you consent to be bound by these Official Rules, which shall constitute a contract between you and Procter & Gamble ("the Organizers"). All decisions of the Organizers with respect to the Challenge shall be final.
Eligibility
Entrants must be at least 18 years old as of the date of entry. Officers, directors, and employees of the Organizers, as well as those individuals' immediate family members and the residents of their households, are not eligible. Participants may enter max. 5 proposals per round. Entries have no value and an entry does not entitle an Entrant to any compensation of any type or kind.
Posting, submitting or any other use of any name or email address the Entrant is not authorized to use is strictly prohibited. If the Entrant’s email address rejects incoming email or is otherwise invalid, the entry is not valid. By submitting to the Challenge web page, the Entrants agree to receive an email to confirm their posting. The Entrants also agree to be added to the Organizers mailing lists and to receive further messages. The Entrant may request to be removed from the mailing list at any time by using this link or by sending an email to a special control address, unsubscribe@hugocreate.com, with the word unsubscribe as subject.
In the event of a dispute as to the identity of a Winner based on an e-mail address, the Winner will be declared to be the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entrants shall be responsible for providing proof that they are the "authorized account holder" of an e-mail address.
How to enter
Entrants must navigate to the Challenge web page located at www.hugocreate.com and fully and properly complete an online entry form, including a submission of the Entrant's design. The designs must comply with the technical specifications. Entry is not valid and completed until you have received confirmation from Organizers via e-mail.
Design standards
Designs submitted by an Entrant must comply with the following standards:
-All submissions and design elements must be original and authored by the Entrant.
-No trademarks, service marks, trade names, brands, or copyrighted material of third parties.
-No names or depictions of public figures, public officials, or celebrities.
-No personal information, for example, phone numbers, addresses, …
-No obscene, vulgar, pornographic, profane, or violent statements or images.
-No depictions of alcohol, tobacco, firearms, gambling, drug use, or illegal conduct.
-No religious, bigoted, racist, or overtly political statements or images.
-No defamatory images or statements.
Selection criteria
An independent judging panel will assess the proposals and make a selection of the entries that respond best to the selection criteria. The judging panel will base their decisions on the design's imagination, creativity, artistic value, originality and how the given themes are respected. The decision of the judging panel is final and no correspondence shall be entered into. The designers of the selected proposals will receive an e-mail confirming the fact that their design has been selected.
Notification of the Winners
The names of the Winners will be posted on the ‘HUGO Create’ website, and the Winners will also be notified by a personal e-mail. The Winner must execute and provide to the Organizers: (1) an Affidavit of Eligibility and Assignment of Rights, attesting to the Winner's eligibility, compliance with these Official Rules, and assignment of proprietary rights in the Winner's design; (2) a Liability Release, releasing the Organizers from any liability arising out of the Challenge; and (3) a Publicity Release, allowing the Organizers to use the Winner's name, likeness and biographical information for publicity purposes. Winners shall be responsible for all taxes, fees, and expenses of receiving the prizes awarded. Organizers reserve the right to substitute equivalent prizes of equal value in the event prizes are not available at the time of the selection of Winners.
Termination of the Challenge
The Organizers reserve the right, exercisable upon its sole discretion, to disqualify any individual they find has (1) violated these Official Rules; (2) interfered with the entry process or the operation of the Challenge; (3) violated any law or regulation by participating in the Challenge; or (4) fraudulently completed the entry form or provided other false information to the Organizers. If, for any reason, the administration, security, fairness, or integrity of the Challenge has been compromised, the Organizers reserve the right, exercisable at their sole discretion, to cancel, terminate, modify or suspend the Challenge.
Timetable
The Challenge (commencement of the period for submitting proposals) begins on February 1, 2008 at 12:01 a.m. Central Time and concludes on December 31, 2008, at 11:59 p.m. Central Time. Entries received before or after the Challenge period will not be accepted. Time deadlines will be determined solely according to the Organizers's clock.
Ownership of proposals and reproduction rights
The designers transfer all copyright and other intellectual or industrial property rights relating to his or her proposal. These rights will then become the exclusive property of the Organizers which will be able to use, publish or dispose of them as it sees fit, without geographical limitation or any other restriction, via all forms of printed (publications, posters, promotional material, etc.), digital (websites, multimedia presentations, etc.) and/or audiovisual media.
The designers of the selected proposals will receive an e-mail confirming their entry in the Challenge and the fact that they have been selected.
Every Entrant accepts that his or her proposal may be the subject of publicity about the Challenge.
Consequently, Entrants hereby authorize the Organizers to mention the proposals selected, as well as the names of their designers in press releases, information documents and publications, and to display the designs on the ‘HUGO Create’ website, in particular, as well as on any other websites and/or in public events of its choice, without restriction as to length of time and without such publication conferring any right to remuneration or benefit. For this purpose, the Organizers may produce all copies, graphic representations or photographs of the entries, on condition that the names of the designers are stated.
Every Entrant formally acknowledges that any proposal submitted in no way breaches the rights of any third parties, and will indemnify the Organizers from any claim or appeal in this regard.
Acceptance of the rules and regulations
Entering the Challenge implies pure and simple acceptance of these rules and regulations. Interpretation of these rules and regulations comes under the sole jurisdiction of the Organizers.
Amendment of rules
The Official Rules may be amended by the Organizers in their sole discretion. Amendments will be posted on the Organizers’ website. Unless otherwise specified, any amendments will become effective at 12:00:01 a.m. CT on the day after they are posted on this site. By entering the Challenge after the amendment of the Official Rules, you are consenting to be bound by the amendments.
Dispute resolution
Venue of any action brought concerning the Challenge shall be in Geneva, Switzerland, and shall not be subject to transfer to another venue or locale for any reason. By entering the Challenge, you agree that you will not commence or participate in any class action litigation, or join with any other person in a legal proceeding, concerning the Challenge. The Challenge, and any legal proceeding arising there from, shall be governed by the laws of Switzerland, without regard to its conflict of laws principles.
Responsibility of the Organizers
The Organizers reserve the right to shorten, extend, defer, modify or cancel this Challenge for any reason whatsoever. In the same way, the liability of the Organizers may not be invoked should access to or viewing of the ‘HUGO Create’ website prove difficult, or even impossible, for the Entrants. Organizers assume no responsibility for the inability to complete the entry process due to any software, hardware, telephone, modem, or internet malfunctions, problems or failures, including the unavailability of Organizers’ website due to such malfunctions, problems or failures.
Disclaimer of liability and warranties
In no event will the Organizers, their respective officers, directors, employees, representatives or agents, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, statutory or punitive damages. Without limiting the foregoing, with respect to the Challenge and to the prizes, the Organizers makes no warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability or fitness for a particular purpose.
