Official rules for the game "Ice-Easter”
Article I: Organisation
The company ICE SA S.A. (“ICE SA”) with VAT number 0445.215.746, having its registered offices at 37R, avenue Mathieu, 6600 Bastogne, Belgium, is organising a contest called “Ice-Easter” (hereafter “the contest”), from 7 April 2014 to 27 April 2014 (midnight GMT+2).
By participating in the contest, participants fully and unreservedly accept the present rules and confirm that they understand these. Participants who do not comply with these rules will not be eligible to participate or win a prize.
Article II: Participation
Participation in the contest is free of charge and entails no obligation to make a purchase. The contest is open to any individual over the age of 18 (except for members of staff and representatives of the organising company, its partners and its subcontractors, and members of their families) with an Internet connection and a valid e-mail address, with no residence condition (hereafter “the participant” or the “participants”).
Participation is strictly personal; the participant cannot play on behalf of another participant.
The participant may take part in the contest once a day.
The participant must conform to the procedures set out in point IV of the present rules in order to participate to the contest.
It is not possible to participate in the contest in a manner other than that described in the present rules.
Article III: The contest
The contest is the following: participants will need to complete a Memory-like game and find all 8 pairs hidden in the grass. A visible timer will help to determine the three contestants with the best times, who will win the first prizes. 7 other winners will be drawn out from all the contestants who completed the game.
To compete, Participants have to complete the entry form found on Facebook by answering each of the questions and returning the entry form, and then by pressing “Submit”.
After validation, each Participant will receive, on a web page, confirmation of his/her participation. If the Participant forgets to include in the entry form one of the required fields, a message will ask him/her to complete the omitted mention.
Each participant into the contest can win maximum one prize.
Article IV: Procedures
In order to participate in the contest, the participant must have an account on the site www.facebook.com, connect to the site’s address http://www.facebook.com/ice.watch, click on "Ice-Easter" in the navigation menu, take part in the contest, accept all the authorisations required for the application and accept the present rules.
The contest is in no way managed, supported or sponsored by Facebook. ICE SA relieves Facebook of all responsibility for the contest, its organisation and its execution.
Article VII: Winners
In April 2014, ICE SA will select 10 winners. The 3 first prizes will be awarded to the 3 participants who completed the game with the best time, and the 7 remaining prizes will be awarded by a drawing of lots by computer.
The company ICE SA reserves the right to disqualify a participant who has not provided correct information or who is suspected of cheating. In this case, the participant next in the ranking will automatically take his place, and so on. Any additional information that may serve to verify the conditions imposed by this rule must be provided by the participant if it is demanded of him. In the event of non-compliance with the present rules, the participant whose participation has been voided will be informed of this and he may be definitively excluded from the contest.
Article VIII: Prizes
The 10 Winners will be awarded the following prizes :
The 3 contestants with the best times will receive: 1 watch of their choice in one of the following collections: Ice-Forever (Mini or Small size) or Ice-Mini and a belgian chocolate box.
The 7 following winners will receive 1 Ice-Forever (mini size) of their choice.
The company ICE SA will inform the Winners of the results personally by e-mail and deliver the watch within eight weeks of the end of the contest. The prizes will be sent to the address that the participant has given to the company ICE SA as part of the contest.
The Winner authorises the company ICE SA to make the necessary checks of their personal information, their identity and their domicile (postal and/or IP address). In the event that one of these pieces of information is incorrect, it will be considered that the prize has not been awarded to the participant, and no prize will be delivered.
The prizes awarded cannot be swapped for cash or for anything else whatsoever.
The prizes will be sent by UPS at the expense of the company ICE SA, with the exception of any potential additional costs after they have been dispatched (customs charges etc.), which will be paid exclusively by the participant. Delivery times may vary depending on the destination. The company ICE SA will therefore not be held liable for any delivery delay, any delivery fault or any damage whatsoever to the prizes attributable to UPS.
Prizes must be accepted as such and will not be refunded, exchanged or be the subject of a financial compensation.
ICE SA reserves the right to replace the prize(s) by one/other prize(s) of equal value, without giving rise to any claim.
If a winner is unable to enjoy his/her prize, he/she cannot give it to the person of his/her choice and the prize will return automatically the property of the Organizer, no claim will be accepted.
Article IX: Data Protection
Participants agree to the collection, recording and storage of personal data (surname, first name, postal address and e-mail address) that are necessary for the conduct of the contest and for the awarding of a prize by the company ICE SA during the entire duration of the contest and afterwards. The information obtained will be collected, processed and stored only by the company ICE SA for its own use, to the exclusion of any third parties and Facebook. ICE SA will use these data during the entire duration of the contest in order to inform participants regularly by e-mail of the progress of the contest, their position in the rankings and that they have potentially won a prize. The participant is aware that his/her name will be disclosed for the purpose of the contest and should he/she be a Winner.
After the contest, the data that have been collected may also be used by the company ICE SA for future promotional mail-outs about the brand Ice-Watch. The participant can request not to receive these promotional mail-outs by sending an e-mail to the address web@ice-watch.com.
Information about participants’ names, addresses and electronic addresses collected as part of the contest will be processed in accordance with the Belgian law of 8th December 1992 regarding the protection of privacy with respect to the processing of personal data (Data Protection Act). The company ICE SA therefore undertakes to check that the confidentiality and security of the data collected are respected.
In accordance with this law, all participants in the contest have the right to access, object to, change, rectify or delete the collected data relating to them. Any request to access, object to, change, rectify or delete data must be addressed to ICE SA, avenue Mathieu 37R, 6600 Bastogne, Belgium or to the e-mail address web@ice-watch.com.
Article X: The Rules
The rules will enter into force as soon as they are put online and it will be considered that participants have fully accepted them by the simple fact of participating in the contest.
It will also be considered that participants have accepted subsequent decisions that the company ICE SA may be led to make in order to guarantee that the contest can take place correctly in the event of force majeure.
The rules will be sent free of charge to any person who requests them, before the date the contest closes, in writing by letter to the following address: ICE SA, avenue Mathieu 37R, 6600 Bastogne, Belgium. Postage costs for this request are refundable up to a limit of one reimbursement per household (with the same address) for a request made before the end of the contest (as proven by the postmark) on the basis of a postage stamp that is currently in use for a letter weighing at least 20 grams.
Article XI: Modification, Cancellation, Suspension, Disqualification
Participation in the contest implies an honest attitude, entailing absolute respect for the rules and the rights of other participants.
The company ICE SA reserves the right to cancel, shorten, extend, change or postpone the contest at any time and without warning if circumstances require it, without being held liable.
Any modification of these regulations will come into force from their online publication and any participant will be deemed to have accepted them due to his/her participation in the contest from the date of the entry into force of the modification. Any participant refusing the change(s) will have to stop participating in the contest.
As far as possible, these changes will be announced in advance by all appropriate means.
The company ICE SA may stop and cancel a participant’s participation in the event of suspect behaviour being noted, such as: setting up an automated reply system; several people and computers being connected using the same identifier; unusual wins and account multiplication.
The company ICE SA is the only entity that can decide on the exclusion or reintegration of participants, with reference to information in its possession. In the event of a complaint, the onus is on the participant to prove that his behaviour was compliant with the present rules. The company ICE SA cannot be held liable in this situation.
Article XII: Connection and Usage
Participation in the contest implies knowledge and acceptance of the characteristics and limitations of the Internet, notably regarding technical performances, download and response times, the lack of protection certain data enjoy against hijacking, and the risk of contamination with viruses potentially circulating on the network.
The company ICE SA refuses liability in the event of inappropriate usage or incident associated with the use of the application, the computer or the Internet access, or inappropriate usage or malfunction of servers, the telephone line or the Facebook website, or any other technical problem that could occur during the present contest and the identification of the Winners.
Article XIII: Facebook
The anchor point for the present contest is the Facebook website. All participants must respect the terms of use of the Facebook website. Furthermore, the participant confirms that she/he is aware of the general terms of use and of the confidentiality policy of the Facebook website, which can be consulted directly on the Facebook website. Facebook’s registered office is at 1601 S. California Ave., Palo Alto, CA 94304, USA. The company ICE SA accepts no liability for the content and usage of the Facebook website, and confirms that it is aware that Facebook neither manages nor sponsors the contest.
Article XIV: Jurisdiction and Applicable Legislation
The present contest and rules are subject to Belgian law. Any dispute that cannot be settled amicably shall be referred to the Belgian courts.
Article XV: Literary and Artistic Property Rights
In accordance with the laws governing literary and artistic property rights, the reproduction and representation of all or part of the elements making up the contest is strictly forbidden.
Article XVI: Severability
If part or all of a clause is invalidated, the present rules shall nonetheless remain valid. The other clauses or parts of clauses shall remain in force and shall be fully applicable and enforceable against participants.
