Official Rules

Icebreaker "Win Pursuit Series Contest 2017" (the "Contest") commences on Monday July 24th, 2017 @12:01am PST and ends on Sunday, July 31st, 2017 at 12:00am (midnight) PST (‘Contest Period’).
ELIGIBILITY : This Contest is open to residents of the USA. Employees of Icebreaker ("Sponsor"), and their respective parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate family and persons living in the same household, whether or not related, of such employees, are not eligible to enter or win. The Contest is subject to all applicable federal, state and local laws.
HOW TO ENTER : Participants may enter the Contest by one of two ways:
By signing up on the “Win Salt Lake City” contest entry form; or
By Signing up via entry form at any Icebreaker branded store.
ENTRY : For purposes of these Official Rules, "receipt" of an electronic entry occurs when Icebreaker’s servers record the entry information upon clicking the "Submit" or “Accept” button. Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by Sponsor of an entry for purposes of these Official Rules. In the event of a dispute about the identity of an online entrant, each entry will be declared made by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet Access Provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
LIMIT OF ONE ENTRY PER PERSON, PER EMAIL ADDRESS, OR PER HOUSEHOLD ADDRESS DURING THE CONTEST PERIOD. Entries generated by script, macro or other automated means are void. Limit one (1) Entry per person, per email address and per household, regardless of method of entry per day. Entries received from any person or email address or household in excess of the limitation will be void. All Entries become the sole property of the Sponsor and will not be returned.
Icebreaker reserves the right at its sole discretion to disqualify any individual it finds to be:
tampering or attempting to tamper with the entry process or the operation of the Contest;
violating the Official Rules; or
acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
PRIVACY: By entering the Contest, participants are agreeing to the collection, use and disclosure of their personal information for the purposes of administering the Contest, and if applicable to receive future emails from Icebreaker about products, service, events, news. Icebreaker will nor sell, trade, rent, or loan this personal information to any other organizations. Icebreaker will protect the entrant's Personal Information in a manner that is consistent with its Privacy Policy.
WINNER SELECTION: Two (2) potential winners will be selected by random draw within the five (5) business days after the end of the Contest Period (pursuant to the Prizes set out below). The draw will be made at Icebreaker Unit 502 - 21 Water Street, Vancouver, BC, V6B 1A1, CANADA. The chances of being selected depend upon the number of eligible participants. The selected participants will be notified by email within five (5) business days of the draw. If an eligible Canadian entrant is selected as a potential winner, he/she will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question administered by telephone at a pre-arranged, mutually convenient time before being declared a winner. If a selected Canadian potential winner cannot be reached by telephone within a reasonable time period or fails to correctly answer the skill-testing question, as determined at Sponsor’s sole discretion, he/she may be disqualified, and Sponsor will select another potential winner from the pool of eligible entries for that drawing.
PRIZE: There are two prizes:
There is one (1) grand prize available consisting of 2 tickets to the Salt Lake City Pursuit Series and a selection of Icebreaker gear (one male and one female item). The offer is valid August 11, 2017 to August 13, 2017. Transport and other expenses are expressly excluded.
REDEEMING THE PRIZE: The winner will be drawn at random. Winners will be notified by email. Upon notification, the selected potential winner must respond to the email or to the contact number provided in the notification within five (5) business days. If the selected potential winner does not respond in accordance with the Official Rules, his/her prize will be forfeited.
RELEASE AND LIABILITY: By submitting your Entry, you agree that your Entry conforms to these Official Rules and that Sponsor, in its sole discretion, may disqualify your Entry for any reason, including if it determines, in its sole discretion, that your Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by Sponsor, in its sole discretion.
No correspondence will be entered into with participants except with the winner.
Icebreaker reserves the right in its sole discretion to cancel or suspend the contest for any reason or should causes beyond the control of Icebreaker corrupt the administration, security, fairness, integrity or proper conduct of the Contest.
Icebreaker assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction to or unauthorized alteration of the entries. Icebreaker is not responsible for
any problems or technical malfunctions or any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software;
the failure of any e-mail or entry to be received by Icebreaker on account of technical problems or traffic congestion on the Internet or at any web site; or
any combination thereof.
Participant agrees that:
any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than those concerning the administration of the Contest or the determination of winners, shall be resolved individually, without resort to any form of class action;
any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by a court of competent jurisdiction located in Vancouver, Canada.
any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and
under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
In the event of any discrepancy or inconsistency between the Official Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry form, or point of sale, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern and control.
Miscellaneous:Icebreaker is not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered or garbled Entries or votes; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of Entries, the tabulation of favorites, the announcement of the winner(s). Icebreaker is also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Icebreaker is not responsible for injury or damage to any person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Contest or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, select the potential winner[s] from all eligible, non-suspect Entries received prior to action taken using the winner determination procedure outlined above.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
