Please read these Terms and Conditions carefully. If you do not agree to accept them, you should not proceed any further with the “Surprises Make Surprises” (“Contest”) presented by Kia Motors Corporation (“Kia”).

By continuing to participate in the Contest, you agree to be bound by the following Terms and Conditions.

The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Google+, or LinkedIn. You are providing your information to Kia and not to Facebook, Twitter, Google+, or LinkedIn. The information you are providing will be used for marketing purposes by Kia.
1. Eligibility

1-1. Every application to participate in the Contest shall be made by a natural person (“Participant” or “Participants”).

1-2. Entry and participation in the Contest is free and you may enter more than once. If you wish to be a Facebook, Twitter, Google+, or LinkedIn user to participate in the Contest, please refer to the Statement of Rights and Responsibilities of each site accordingly at : www.facebook.com, www.twitter.com, plus.google.com, or www.linkedin.com.

1-3. There is no limit to the number of people that can participate in the Contest.

1-4. Employees of Kia (and/or any employee of associated companies of Kia) may participate in the Contest for their own enjoyment: however, they are not eligible for any prizes.

1-5. Kia reserves the right to exclude any person, or persons, from the Contest who infringe upon the stated conditions of entry. Any person, or persons, using prohibited aids, or otherwise seeking to obtain advantage by manipulations of any kind whatsoever, will be excluded from the Contest as well. In such cases, Kia also reserves the right to disallow prizes already awarded and demand return or repayment for the value of the prizes awarded thereafter.

1-6. Participants shall take part via their own email address or Facebook, Twitter, Google+, or LinkedIn account. Any person, or persons, found using a fraudulent account or not that of their own will have their winning entry voided and Kia reserves the right to pursue legal action.

1-7. Kia reserves the right to refuse or accept any content from Participants that is deemed inappropriate at sole discretion of Kia.

2. Contest

2-1. The Contest is about submitting an idea to surprise someone special.

2-2. There is no charge for entering this Contest. You must have access to the internet as the Contest can only be entered online.

2-3. The Contest period is from 00:00:00 (GMT) on 13/06/2014 until 03:00:00 (GMT) on 28/07/2014 (“Contest Period”).

2-4. To enter this Contest, during the Contest Period go to http://surprise.kia.com (“Contest Page”).
- Step 1. Enter your name.
- Step 2. Enter recipient’s name.
- Step 3. Enter where and how you want to surprise someone special to you.
- Step 4. Sign up with your email address or log in with your Facebook, Twitter, Google+, or LinkedIn account. If you wish to log in with one of your SNS accounts, you need to permit Kia to receive your profile information.

You may also participate by commenting on the Surprises Make Surprises post at Kia Motor’s Worldwide Facebook page. Please make sure to submit the required information, such as the recipient’s name and the idea on how to surprise the recipient.
3. Evaluation Criteria

3-1. One (1) winner will be selected by a random draw every week.

3-2. One (1) grand prize winner will be selected by Kia.
- A creative and original surprise idea will have a higher chance of winning the grand prize.
- A surprise idea with the higher number of cheers will have a higher chance of winning the grand prize.
4. Prize

4-1. Total five (5) weekly winners will receive the official match ball, Brazuca.

4-2. One (1) grand prize winner will have the surprise idea happen by Kia. Kia will fund up to 30,000 USD in turning the idea into an actual event.

4-3. The winner announcement and the prize dispatch will take place after the Contest is over.

4-4. The winners will be announced on the Contest Page and notified through the contact information provided at the time of entry. If the winner registered an email address, the winner will be notified through the email. If the winner logged in with one of their SNS accounts, a message of the SNS will be sent. If the winner does not respond to the email or the message notification within 5 days, another candidate will take his/her place as the winner.

4-5. No cash or prize substitutions are allowed except at the discretion of Kia.

4-6. Although Kia’s distribution of the prizes may be delayed for any reason, no interest will be paid on the prizes, and prizes cannot be transferred without the prior written consent of Kia.

4-7. Kia shall not be responsible for any local tax that the winner is required to pay resulting from the acceptance of the prize.

4-8. If the prizes cannot be awarded due to circumstances beyond the control of Kia, Kia at its sole discretion reserves the right to substitute prize of equal value.

5. Liability

5-1. All contractual obligation of Kia are deemed to be fulfilled on delivery of prizes to the winners. Kia shall not be responsible for any material defect of the prizes.

5-2. Any announcement or publication of winners’ names is unofficial and does not constitute a guarantee to the winner that the prize will be awarded to him/her. No potential winner is deemed to have won a prize until his/her eligibility has been confirmed by Kia’s verification process.

5-3. Kia shall not be liable for:
(i) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate, misrepresented or unintelligible entries, communications or affidavits, regardless of the method of transmission;
(ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors;
(iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials;
(iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Contest; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Contest. Kia disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with the Contest, and reserves the right, in its sole discretion, to cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Kia’s control, corrupt the administration, security or proper play of the Contest.

5-4. By participating in the Contest, you agree that no claim shall be asserted against Kia, its affiliates or any their respective directors, officers, employees or against in respect of any and all losses or injuries (including without limitation special, indirect or consequential losses), damages, rights, claims or actions of any kind whatsoever that result from your participation to the Contest and/or your acceptance and enjoyment of the prize. You further agree to no claim to Facebook, Twitter, Google+, or LinkedIn and completely release Facebook, Twitter, Google+, or LinkedIn from any responsibility in relation to Contest.

6. Ownership of Content

6-1. Participants bear sole liability and sole responsibility for the legality of the data and for ensuring that they have the necessary rights to digital data supplied by them. Participants shall be liable for and hold Kia harmless from and against all losses and damages incurred and suits and claim brought by third party due to possible infringement of intellectual proprietary right of the third party. Participants shall, their own expense, take charge of the defense of any such suits and claim.

6-2. Digital data and information must not contain statements of a racist, sexist, defamatory nature, statements glorifying violence or which could be construed as deriding, insulting or similarly offending specific individuals or groups. Any participants violating this condition will be excluded from the Contest forthwith and Kia reserves the right to take further legal action.

6-3. By entering the Contest, except where prohibited by law, each Participant agrees that Kia has the right and permission to use and announce the name, picture, voice, performance, background and biographical data, photograph, image, testimonial, or other likeness and/or prize information or personal exposition (and/or any edited portion thereof), and/or any information contained in his/her entry for promotional, advertising, publicity and/or other purposes in relation to the Contest.

7. Miscellaneous Provisions

7-1. The legal relationship between Kia and Participants is governed by the laws of the Republic of Korea. Any and all legal actions or claims arising in connection with these promotions and contests must be brought in a court of competent jurisdiction in Seoul, Republic of Korea.

7-2. Kia is subject to the Republic of Korea data protection laws when collecting and processing personal data. However, if you communicate with Kia in regards to any and all legal actions or claims arising in connection with this Contest by email, you should note that the security of Internet email is uncertain. By sending sensitive or confidential email messages that are not encrypted you accept the risks of such uncertainty and possible lack of confidentiality over the Internet.

7-3. Kia reserves the right to amend these Terms Conditions of entry at any time without prior notice.

7-4. Informative and explanatory material relating to the Contest from an integral part of these Terms and Conditions. However, any terms and conditions on the informative and explanatory material relating to the Contest that are contradictory to these Terms and Conditions shall be invalid and these Terms and Conditions shall prevail.

Requests received after the close of the promotion period will not be honored.
