REGLEMENT COMPLET DU JEU Michelin Motorsport du 29 mai au 3 juin 2018 Pack Endurance ARTICLE 1 – Société Organisatrice La Manufacture Française des Pneumatiques Michelin, société en commandite par actions, au capital de 504.000.004€, dont le siège est situé Place des Carmes Déchaux, à Clermont- Ferrand (63040) (ci-après « l’Organisateur » et/ou « Michelin »), immatriculée au Registre du Commerce et des Sociétés de ladite ville sous le n° 855 200 507 RCS Clermont-Ferrand, organise du 29 mai 2018 10H00 au 3 juin 2018 23h59 inclus à partir de la page Facebook https://www.facebook.com/michelinmotorsport, un jeu (Ci-après « le Jeu ») dont la participation est entièrement gratuite et sans obligation d’achat. Cette opération n’est ni parrainée, ni organisée par Facebook. ARTICLE 2 - ACCEPTATION DU PRESENT REGLEMENT La participation au Jeu implique l’acceptation sans réserve par les participants du présent règlement en toutes ses dispositions ainsi que des lois et règlements en vigueur applicables aux jeux gratuits. Il est de la responsabilité de chaque participant de vérifier que son pays autorise la participation au Jeu. Ne peuvent pas participer au Jeu les personnes ne répondant pas aux conditions visées ci-dessus et en tout état de cause : Les membres de la direction et du personnel de l’Organisateur ayant collaboré à ce Jeu directement ou indirectement, Les personnes physiques ou morales ayant collaboré à la conception, l’organisation et la gestion de ce Jeu directement ou indirectement Les membres de leurs familles respectives (par famille, il faut entendre les personnes vivant sous le même toit, ainsi que leurs ascendants et descendants directs et/ou indirects et/ou collatéraux) ; L’Organisateur se réserve le droit de procéder à toute vérification pour le respect du présent article comme de l’ensemble du règlement, notamment pour écarter tout participant mineur, tout participant ayant commis un abus quelconque ou une tentative de fraude, sans toutefois qu’elle ait l’obligation de procéder à une vérification systématique de l’ensemble des participations, mais pouvant éventuellement limiter cette vérification aux gagnants potentiels. Il n’est autorisé qu’une seule participation par personne, même nom et prénom, même adresse, même identifiant Facebook, pendant toute la période du Jeu. Une même personne physique ne peut jouer à partir d’un compte de joueur tiers, c’est-à-dire au bénéfice d’une autre personne qu’elle-même. La volonté de fraude avérée ou la tentative de tricherie démontrée d’un participant, notamment par la création de fausses identités permettant de s’inscrire plusieurs fois pourra être sanctionnée par l’interdiction formelle et définitive d’être récompensé et déclaré gagnant. Les participants ne respectant pas l’une ou l’autre des conditions énoncées au présent article seront automatiquement disqualifiés. Toute participation incomplète, illisible et/ou comportant des coordonnées inexactes, sera considérée comme irrecevable. L’organisateur se réserve le droit de disqualifier un joueur suite à des commentaires et/ou message incitant à : la discrimination, à la haine ou à la violence : à caractère raciste, xénophobe, sexiste, homophobe ou révisionniste. La contribution de message à caractère diffamatoire ou dénigrant au tabagisme, à la consommation excessive d’alcool ou à la consommation de substances faisant l’objet d’une interdiction législative à la commission de crimes et/ ou délits, au suicide ou à la consommation et à la vente de substances illicites la contribution de message hors contexte : politique, religieux… la contribution à caractère pornographique (et images de nudité), pédophile, violent. Spams ARTICLE 5 – ACCES AU JEU Le Jeu est ouvert à partir du 29 mai 2018 à 10h00 exclusivement sur la page Facebook suivante : https://www.facebook.com/michelinmotorsport Date et heure française de connexion faisant foi. Pendant cette période, le Jeu est accessible tous les jours, 24 heures sur 24, en se connectant via un navigateur standard, sauf interruption, programmée ou non, pour les besoins de sa maintenance ou pour tout autre cas, notamment une mise à jour des bases de données ou des serveurs d’hébergement. ARTICLE 6 – MODALITES DE PARTICIPATION AU JEU En tout état de cause il ne sera délivré qu’une seule dotation par gagnant (même nom, même adresse postale). Pour participer au Jeu, chaque participant devra se rendre sur https://www.facebook.com/michelinmotorsport, puis sur la publication avec la mention [concours], liker et partager le post et tagguez un ami en commentaire. En partageant et en cliquant sur « commentez » et en tagguant un ami, les utilisateurs acceptent le règlement du Jeu. Le participant ne peut gagner qu’une seule fois pendant la durée du jeu. L’accès au jeu est limité à une participation par personne (même nom, même prénom, même adresse postale), quel que soit le nombre d’adresses électroniques/comptes Facebook dont elle dispose. En cas de participations multiples lors d’une seule et même session, et ce, notamment par l’intermédiaire de plusieurs adresses électroniques différentes, le participant sera exclu définitivement du jeu et perdra son gain le cas échéant. En tout état de cause il ne sera délivré qu’une seule dotation par gagnant (même nom, même adresse postale). ARTICLE 7 – MODALITES D’ATTRIBUTION DES DOTATIONS Il sera organisé un tirage au sort électronique pour désigner les 10 gagnants parmi l’ensemble des participants ayant rempli les conditions du jeu. Le tirage au sort qui déterminera les gagnants sera organisé le lundi 4 juin 2018. Les noms des gagnants seront affichés sur la Page Facebook « Michelin Motorsport » et resteront en ligne 3 mois après la fin du jeu. Les dotations ne pourront être attribuées sous une autre forme que celle prévue au présent règlement. Il ne sera attribué aucune autre dotation ou valeur en espèces, en échange des dotations gagnées. Toutefois, l’Organisateur se réserve le droit de remplacer les dotations mises en jeu par des dotations de même valeur et de caractéristiques proches si les circonstances l’exigent, sans que sa responsabilité ne puisse être engagée de ce fait. ARTICLE 9 – MISE EN POSSESSION DES DOTATIONS Les gagnants seront avisés par la page Facebook et devra ensuite contacter Michelin Motorsport sur Facebook en message privé. Les modalités pour entrer en possession des dotations seront indiquées dans ce message. Si les gagnants ne répondent pas dans un délai de 2 jours ou si les coordonnées sont incorrectes, incomplètes, illisibles, contrefaites ou réalisées de manière contrevenante au présent règlement, la dotation ne sera pas attribuée à un gagnant suppléant. De même, si le gagnant décline le lot, ceux-ci ne seront pas attribués aux gagnants suivants. ARTICLE 10 – RESPONSABILITÉ CAS DE FORCE MAJEURE / RESERVE DE PROLONGATION La responsabilité de Michelin ne saurait être encourue si, pour un cas de force majeure ou indépendant de sa volonté, le présent Jeu devait être modifié, prorogé, écourté ou annulé, notamment si le Jeu occasionnait des cas de tricherie imprévus et/ou abus quelconques. L’Organisateur se réserve la faculté de mettre fin au présent Jeu sans désigner de gagnant et de remettre en jeu la dotation lors d’une prochaine opération. Elle se réserve dans tous les cas la possibilité de prolonger le Jeu, le modifier, l’écourter ou l’annuler et de reporter toute date annoncée. L’Organisateur ne saurait être tenu responsable dans le cas où l’un des gagnants ne pourrait être joint par courrier électronique, pour une raison indépendante de sa volonté (notamment en cas de problème technique lié au fournisseur d’accès, à l’opérateur téléphonique ou en cas d’indication d’une mauvaise adresse électronique). Dans ces cas, les gagnants ne pourront prétendre à aucune contrepartie de quelque nature que ce soit. Michelin ne saurait davantage être tenu pour responsable au cas où un ou plusieurs participants ne pourraient parvenir à se connecter au site internet ou à jouer au Jeu du fait de tout défaut technique ou de tout problème lié notamment à l’encombrement du réseau Internet. En particulier, Michelin ne pourrait être tenu pour responsable de tout dommage matériel ou immatériel causé, à leur équipement informatique, aux données qui y sont stockées et aux conséquences pouvant en découler sur leur activité personnelle, professionnelle ou commerciale. Seront notamment considérés comme des cas de force majeure, sans que la liste soit limitative : les catastrophes naturelles, les inondations, les grèves, l’interruption du raccordement du fournisseur de réseau, les pannes techniques, les pannes d’électricité, les éventuelles difficultés de connexions, liaisons, ruptures de ligne, pertes d'information ou autres pouvant affecter, différer, ralentir ou interdire l'accès au site du Jeu. L’Organisateur s’engage à mettre en œuvre tous les moyens pour mettre fin à ces situations dans les plus brefs délais. Les participants ne pourront engager sa responsabilité et lui demander une quelconque réparation du fait des modifications ou annulations ainsi survenues. ARTICLE 11 – PROTECTION DES DONNÉES A CARACTÈRE PERSONNEL Les données à caractère personnel que vous pouvez être amené à communiquer à Michelin pour l’envoi de votre dotation sont limitées à vos nom, prénom, adresse e-mail et postale. Ces données sont destinées à l’usage du personnel Michelin et non à Facebook, elles seront conservées le temps nécessaire à la gestion du jeu et au maximum pour une période de 6 mois à l’issue de laquelle elles seront détruites. Conformément à la loi Informatique et Libertés du 6 janvier 1978 modifiée, les participants à ce Jeu bénéficient d’un droit d’accès, de rectification, d’opposition, de suppression des données les concernant. Ces droits pourront être exercés sur simple demande à l’adresse suivante : MFP Michelin – Michelin Motorsport – Adrien Perrier-Cussac – 36 rue du Clos Four – 63100 CLERMONT-FERRAND Les informations communiquées pourront être exploitées par la société organisatrice dans le cadre de la gestion du jeu et en aucun cas par les services de Facebook. ARTICLE 12 - DROITS DE PROPRIETE LITTERAIRE ET ARTISTIQUE Conformément aux lois régissant les droits de propriété littéraire, artistique et industrielle sur le territoire français, la reproduction, la représentation et l'exploitation de tout ou partie des éléments composant le Jeu, sont strictement interdits. Les marques citées dans le cadre du Jeu sont des marques déposées par leurs propriétaires respectifs. ARTICLE 13 – REMBOURSEMENT Le remboursement des frais d’affranchissement relatifs à la demande de règlement (timbre au tarif lent en vigueur), peut être obtenu sur simple demande écrite conjointe à l’adresse de l’Organisateur en joignant un R.I.B (ou R.I.P ou R.I.C.E). Le remboursement des frais de connexion internet pour participer au Jeu, dans la limite maximum de 6 (six) minutes et hors participation mobile, peut être obtenu sur simple demande écrite à l’adresse de l’Organisateur en précisant lisiblement les informations suivantes : nom, prénom, adresse postale complète, date et heure de participation. La demande de remboursement devra être accompagnée d’un RIB, RIP ou RICE et d’une copie de la facture du fournisseur d’accès à internet du participant où apparaissent : d’une part la nature exacte de la prestation du fournisseur d’accès à internet et son mode de facturation (illimitée, forfaitaire…) et, d’autre part, les date et heure de connexion correspondant à la participation au Jeu clairement soulignées ou surlignées par le participant. Etant observé qu'en l'état actuel des offres de service et de la technique, certains fournisseurs d'accès à Internet offrent une connexion gratuite ou forfaitaire aux internautes, il est expressément convenu que tout accès au site s'effectuant sur une base gratuite ou forfaitaire (tels que notamment connexion par câble, ADSL ou liaison spécialisée) ne pourra donner lieu à aucun remboursement, dans la mesure où l'abonnement aux services du fournisseur d'accès est dans ce cas contracté par l'internaute pour son usage de l'Internet en général et que le fait pour le participant de se connecter au site et de participer au Jeu ne lui occasionne aucun frais ou débours supplémentaire. Les frais de photocopie des éventuels justificatifs à fournir seront remboursés sur la base de 0,15 euro TTC par feuillet. Le remboursement se fera par chèque ou par virement bancaire, ou selon tout autre moyen choisi par l’Organisateur. ARTICLE 14 –COPIE DU PRÉSENT RÈGLEMENT Il peut être obtenu sur simple demande à l’adresse de la société organisatrice, spécifiée à l’article 1, pendant toute la durée du Jeu. Ce règlement complet peut être consulté, téléchargé et imprimé gratuitement sur la page Michelin Motorsport, pendant toute la durée du jeu. ARTICLE 15 – LOI APPLICABLE Le Jeu ainsi que le présent règlement sont soumis à la loi française. En cas de contradiction entre la version française et les traductions effectuées en diverses langues, c’est la version française qui prévaut. Toute interprétation litigieuse du présent règlement ainsi que tous les cas non prévus seront tranchés par un jury désigné par l’Organisateur. Toute demande concernant l’interprétation du règlement doit parvenir par écrit. Il ne sera répondu à aucune demande concernant l’interprétation du présent règlement qui parviendra chez l’Organisateur plus de quinze (15) jours après la fin du Jeu. Toute difficulté d’interprétation et tout cas litigieux seront tranchés en dernier ressort par les Tribunaux de Clermont-Ferrand (France) au regard des lois françaises. This operation is neither sponsored nor organised by Facebook. ARTICLE 2 – ACCEPTING THE PRESENT RULES Participating in the game will be taken as acceptance by participants of the present rules and all provisions therein, as well as current laws and regulations in force which apply to free games. Those who do not meet the aforementioned conditions may not participate in the Game, neither may the following people under any circumstances: Members of the Organiser's management or staff who have directly or indirectly been involved in the Game, Physical or moral persons who have been involved in the creation, organisation and management of this Game, directly or indirectly Members of their respective families ('family' denotes those living under the same roof, as well as their direct and/or indirect and/or collateral ancestors and descendants) The Organiser reserves the right to carry out any checks relating to compliance with the present article as with the full rules, in particular to exclude any participants who are minors, any participants who have committed any form of offence or fraud attempt, without, however, being under any obligation to carry out systematic checks on all participants, but having the right to potentially limit these checks to potential winners. Spam ARTICLE 5 – ACCESS TO THE GAME The Game will be open from the 29th of May 2018 at 10h00 exclusively on the following Facebook page: https://www.facebook.com/michelinmotorsport In accordance with French date and time. Throughout this period, the Game will be available every day, 24 hours a day, by connecting via a standard browser, apart from interruptions, whether scheduled or not, for maintenance or for any other reason, including to update databases or host servers. ARTICLE 6 – TERMS AND CONDITIONS FOR PARTICIPATION IN THE GAME Under any circumstances, only one prize will be given out per winner (same name, same postal address). In order to take part in the Game, participants must visit https://www.facebook.com/michelinmotorsport, then publish with the comment [Contest], like and share the post and tag a friend in the comments. In sharing and in clicking on "comment" and tagging friend, users accept the Game rules. Participants can only win once in the duration of the game every week. Access to the game is limited: the same person may participate once only (same surname, same first name, same postal address), no matter how many different email addresses/Facebook accounts they may have. In the event that a person participates multiple times in one sole session, and including when it is done via the use of numerous different email addresses, the participant will be excluded definitively and will lose any such winnings as they may have. Under any circumstances, only one prize will be given out per winner (same name, same postal address). ARTICLE 7 - TERMS AND CONDITIONS FOR PRIZE ALLOCATION An electronic random draw will be held to pick 10 winners from among the participants who fill correctly the conditions. The random draw which determines the winner will be held on monday the 4th of June 2018. Prizes cannot be given in any other form than that set out in the present rules. No other prize or cash equivalent will be given in exchange for prizes won. The Organiser does however reserve the right to replace these prizes with others of the same value and similar features if circumstances require, and will not be held liable for this. ARTICLE 9 - CLAIMING PRIZES The winners will be informed via the Facebook page and must then contact Michelin Motorsport via a private Facebook message. Instructions for claiming prizes will be given in this message. If the winner does not respond within 2 days, or if their details are incorrect, incomplete, illegible, counterfeit or do not comply with the present rules, the prize will not be given to a replacement winner. The same applies if the winner does not accept the prize ARTICLE 10 - LIABILITY IN THE EVENT OF FORCE MAJEURE / RIGHT TO EXTENSION Michelin cannot be held liable if, due to force majeure or events beyond their control, this Game needs to be modified, extended, cut short, or cancelled, including if the Game is subject to unforeseen cheating and/or any form of misuse. The Organiser reserves the right to end this Game without naming a winner and to use prizes in a subsequent operation. They reserve the right under all circumstances to extend, modify, cut short, or cancel the Game, and to postpone any dates set out. The Organiser will not be held responsible in the event that a winner cannot be reached by email, for reasons beyond their control (including in the event of technical issues relating to Internet Service Providers, telephone operators, or where the wrong email address has been provided). In these cases, winners are not entitled to any form of compensation whatsoever. Neither will Michelin be held responsible in the event that one or more participants are not able to connect to the website or play the Game as a result of any technical faults or problems, including those related to Internet traffic overload. Specifically, Michelin cannot be held responsible for any tangible or intangible damages, either to IT equipment, data stored on said equipment, or any consequences which may affect participants personal, professional or commercial activity. Cases defined as force majeure include, but are not limited to, the following: natural disasters, floods, strikes, interruptions to internet service providers' connections, technical faults, power cuts, potential difficulties with connection, links, line interruptions, loss of information or any others which may affect, change, slow down or prevent access to the Game site. The Organiser is committed to employing all means necessary to resolve such situations as quickly as possible. Participants cannot hold them liable or demand any form of reparation from them due to any modifications or cancellations occurring as a result. ARTICLE 11 - PROTECTION OF PERSONAL DATA The personal data which you may be asked to provide Michelin with in order to receive your prize are limited to surname, first name, email address and postal address. This data is for Michelin's personal use and not for that of Facebook, and will be stored for as long as necessary for the purposes of the game for a maximum period of 6 months, after which it will be destroyed. In accordance with the modified French law on IT and Freedom of the 6th of January 1978 (loi Informatique et Libertés du 6 janvier 1978 modifiée), participants in this Game have the right to access, rectify, contest, or delete data relating to them. ARTICLE 12 - LITERARY AND ARTISTIC PROPERTY RIGHTS In accordance with French laws governing literary, artistic and industrial property, any reproduction, representation, or use of all or part of the elements comprising the Game is strictly forbidden. Brands used in the Game are registered trademarks of their respective owners. ARTICLE 13 - REIMBURSEMENT A refund of postage costs for claims (current slowest postal service) can be obtained by sending a written request to the Organiser's address with an R.I.B. enclosed (or R.I.P. or R.I.C.) (bank account details) A refund of internet connection costs incurred through participation in the game, up to a maximum of 6 (six) minutes and not including participation on a mobile device, can be obtained by sending a written request to the Organiser's address with the following information specified legibly: surname, first name, full postal address, date and time of participation. Requests for refunds must include a RIB, RIP or RICE and a copy of the bill from the participant's internet service provider showing: both the exact nature of the service provided by the ISP and the billing method (unlimited, flat rate...), and also the date and time of connection corresponding to participation in the Game, clearly underlined or highlighted by the participant. Given that, with current service offers and technology, some internet service providers offer a free or flat rate connection to internet users, it is expressly agreed that any access to the site on a free or fixed-rate basis (including access such as cable, ADSL or leased line) cannot be refunded, as in these cases the internet user has a contract with the internet service provider which covers general internet use, and connecting to the site to participate in the Game does not incur any additional fees or disbursement. Photocopying costs for any documents which have to be provided will be refunded at 0.15 Euros inc.VAT per sheet. Fees will be reimbursed via cheque or bank transfer, or by any other means decided upon by the Organiser. ARTICLE 14 - COPIES OF THE PRESENT RULES These can be obtained by addressing a request to the organising company, detailed in article 1, throughout the duration of the Game. A full version of these rules can be consulted, downloaded and printed without charge on the Michelin Motorsport page, throughout the duration of the Game. ARTICLE 15 - APPLICABLE LAW The Game as well as the present rules are governed by French law. In the event of discrepancies between the French version and translations into different languages, the French version takes precedent. Any disputes regarding interpretation of the present rules, as well as any unforeseen cases, will be decided upon by a jury selected by the Organiser. Any queries regarding interpretation of the rules must be made in writing. There will be no response to queries regarding interpretation of the present rules which reach the Organiser more than fifteen (15) days after the end of the Game. Any issues with interpretation and any disputes will as a last resort be decided upon by the courts in Clermont-Ferrand under French law.
