Règlement du jeu-concours Motul n°154975 Lot principal gagné : (Jeu Facebook) 1 pass VIP + accès grille de départ + accès aux loges et rencontres avec les pilotes (1000 euros) au Grand Prix de France Moto du 18 au 20 mai au Mans (72).

ARTICLE 1 : OBJET
Motul, société domiciliée 119, boulevard Félix Faure BP 94 93303 Aubervilliers Cedex, sous
le numéro 572 055 846, organise du 03 au 10 Mai 2012 un jeu concours (tirage au sort)
intitulé «Motul Challenge : Grand Prix de France Moto».
ARTICLE 2 : CONDITIONS DE PARTICIPATION
2.1 Ce jeu est ouvert à toute personne physique majeure.
2.2 Sont exclus de toute participation au présent jeu et du bénéfice de toute dotation, que ce
soit directement ou indirectement l’ensemble du personnel de la Société, y compris leur
famille et conjoints (mariage, P.A.C.S. ou vie maritale reconnue ou non).
2.3 Les personnes n’ayant pas justifié de leurs coordonnées et identités complètes ou qui les
auront fournies de façon inexacte ou mensongère seront disqualifiées, tout comme les
personnes refusant les collectes, enregistrements et utilisations des informations à caractère
nominatif les concernant et qui sont strictement nécessaires pour les besoins de la gestion du
jeu.
2.4 La participation au jeu implique pour tout participant l'acceptation entière et sans réserve
du présent règlement. Le non-respect dudit règlement entraîne l’annulation automatique de la
participation et de l'attribution éventuelle de gratifications.
ARTICLE 3 : DEROULEMENT DU JEU
Le jeu n’est ouvert qu’aux fans de la page Motul. Il sera donc nécessaire d’aimer les pages
avant d’avoir accès au jeu.
Les participants devront se connecter à partir de la page Facebook www.facebook.com/motul.
Ils devront ensuite soumettre des informations de bases du type civilité, nom, prénom et
adresse email pour participer au tirage au sort. Il leur sera proposé d’inviter des amis pour
optimiser leurs chances de remporter le jeu. Un gagnant sera désigné par tirage au sort.
Le gagnant sera contacté par courrier électronique par l'Organisateur. Si un participant ne se
manifeste pas dans le mois suivant l'envoi de ce courrier électronique, il sera considéré
comme ayant renoncé à son lot et le lot restera la propriété de l'Organisateur.
La société organisatrice informe expressément les participants au Jeu, et les participants au
Jeu reconnaissent, que Facebook ne parraine pas le Jeu ni ne gère le Jeu de quelque façon que
ce soit. Les informations fournies par les participants dans le cadre de la participation au Jeu
sont destinées à la Société Organisatrice, et non à Facebook.
ARTICLE 4 : DÉTERMINATION DU GAGNANT ET DOTATIONS
Lot N°1 :
- Un pass VIP / Un accès grille de départ + accès aux loges et rencontres pilotes.
Lot d’une valeur estimée à 1000€
Il ne pourra être demandé aucune contrevaleur des dotations prévues, en espèce ou sous toute
autre forme, ni un quelconque échange.
ARTICLE 5 : DROITS DE PROPRIETE LITTERAIRE ET ARTISTIQUE.
Chaque participant déclare que tous les éléments qui composent la photo sont libres de tout
droit. En conséquence, chaque participant s'engage à faire son affaire personnelle de toute
réclamation, poursuite, différend ou action éventuelle pouvant émaner de tout tiers
quelconque, quel qu'en soit le fondement, notamment mais sans caractère limitatif : au titre
des droits de propriété intellectuelle (droit d’auteur, droits voisins, droit des marques, dessins
et modèles) et/ou des droits de la personnalité et/ou au titre des éléments composant la photo
réalisée contraires aux lois et règlements en vigueur, notamment mais sans caractère limitatif
à l’ordre public, aux bonnes moeurs, au respect de la dignité de la personne humaine, de la vie
privée.
ARTICLE 6 : MODIFICATION ET ANNULATION DU JEU
La Société se réserve la faculté d’annuler, d’écourter, de prolonger, de suspendre, de modifier
ou de reporter le jeu à tout moment si les circonstances l’exigent, sans que leur responsabilité
ne puisse être engagée sur ces chefs. Dans la mesure du possible, ces modifications ou
changements feront l’objet d’une information préalable par tous moyens appropriés.
ARTICLE 7 : JEU SANS OBLIGATION D’ACHAT
Le remboursement des frais de connexion engagés pour la participation au jeu se fera dans la
limite de 3 minutes de connexion, sur la base du coût de communication locale au tarif France
Telecom en vigueur lors de la rédaction du présent règlement (soit 0.16 euros la minute).
Les participants ne payant pas de frais de connexion liés à l’importance de leurs
communications (titulaires d’un abonnement « illimité », utilisateurs de câble ADSL…) ne
pourront pas obtenir de remboursement.
Le remboursement se fera sur simple demande écrite à la société organisatrice.
Les participants doivent indiquer lisiblement leur nom, prénom, adresse complète, et joindre
impérativement à leur demande un R.I.B (ou un R.I.P.) ainsi que la photocopie de la facture
justificative, avec les dates et heures de connexion clairement soulignées.
Le remboursement des frais de demande de remboursement se fera sur la base d’une lettre
simple de moins de 20 grammes affranchie au tarif économique.
ARTICLE 8 : INFORMATIONS NOMINATIVES.
Toutes les informations que les participants communiquent sur le Formulaire sont uniquement
destinées à la Société, responsable du traitement. Conformément aux dispositions de l'article
27 de la loi n° 78-17 du 6 janvier 1978 modifiée, relative à l'informatique, aux fichiers et aux
libertés, les participants au présent jeu bénéficient d’un droit d’accès, de rectification et de
suppression des données les concernant en adressant à la Société une demande en ce sens par
courrier à la société organisatrice.
Les données personnelles déclarées lors de l’inscription sur Facebook sont stockées et
utilisées conformément aux conditions d’utilisation de Facebook. La société organisatrice
n’est pas responsable du traitement des données déclarées lors de l’inscription au site
«Facebook » et invite les participants à consulter les conditions d’utilisation du site
«Facebook » pour plus d’information
ARTICLE 9 : REGLEMENT DU JEU.
Le présent règlement est déposé via www.depotjeux.com auprès de la COHEN-SKALLIHOBA
située 5 avenue Gabriel Péri BP42 93401 SAINT-OUEN CEDEX Beauvais Cedex. Le
règlement est disponible à titre gratuit à toute personne qui en fait la demande à
l’Organisateur du Jeu. Les timbres liés à la demande écrite d'une copie du règlement seront
remboursés au tarif lent sur simple demande.
ARTICLE 10 : LITIGES.
Toute contestation sur le jeu devra être faite par lettre recommandée avec accusé de réception
dans un délai de dix jours à compter du terme du présent jeu (cachet de la poste faisant foi).
Elle est à adresser à la société organisatrice. Tout litige qui ne pourra être réglé à l’amiable
sera porté devant les Tribunaux compétents désignés selon le Code de Procédure Civile.
ARTICLE 11 : RESPONSABILITE DE LA SOCIETE
Le présent règlement est soumis à la loi française.
En cas de litige survenant à propos de l’organisation de ce concours ou ses suites, les parties
s'efforceront de le régler à l'amiable. Tout litige qui ne pourrait être réglé à l’amiable sera
soumis au tribunal de Bobigny. La Société ne saurait être tenue responsable dans les cas où le
gagnant ne pourrait être joint pour une raison indépendante de sa volonté.
La Société ne peut être tenue responsable si, pour des raisons de forces majeures
indépendantes de sa volonté, le présent jeu était partiellement ou totalement modifié, reporté
ou annulé. Aucune contre-valeur des gratifications mises en jeu ne sera offerte en
compensation.
Motul Challenge: Grand Prix de France Moto
ARTICLE 1: SUBJECT Motul, a company domiciled at 119, boulevard Félix Faure BP 94
93303 Aubervilliers Cedex, under number 055 846/00016, is organising from May 3rd to May 10th
2012, a contest that is entirely free to participate in and without any purchasing obligation.
ARTICLE 2: PARTICIPATION CONDITIONS
2.1 This contest is open to any natural person of age 18 and over.
2.2 Are excluded from participating in this contest and from benefiting from any prize, whether
directly or indirectly, all the personnel of the Company, including their family and spouses
(marriage, P.A.C.S. [civil pact of solidarity] or marital life whether recognised or not).
2.3 People who have not given their full contact details and identities or who have supplied them
inexactly or falsely shall be disqualified, as will people refusing the collection, recording and use
of information of a nominative nature concerning them and which is strictly necessary for the
needs and management of the contest.
2.4 Participation in the contest implies that the participant shall fully and unreservedly accept
these rules. Non-compliance with these rules shall entail automatic cancellation of the
participation and of any award of prizes.
ARTICLE 3: HOW TO PARTICIPATE
The contest is open to Motul page’s Fans only. Indeed liking the page is a mandatory step for
entry in the contest (for those who do not like the pages yet). Participants shall connect to Motul
Facebook wall www.facebook.com/motul.
They shall submit basic contact information such as: title, first and last names, email address.
They are then encouraged to invite their friends to increase their chance to win. A winner will be
drawn by lot.
The winner shall be contacted by email by the Organiser. If a participant does not claim his prize
within one month following the sending of the email, he shall be considered as having renounced
it and it shall remain the property of the Organiser.
The Organiser expressly informs participants and participants acknowledge that the Contest is not
affiliated, sponsored or endorsed by Facebook. Information provided by participants during the
contest is solely intended for the Organiser; not Facebook.
ARTICLE 4: DETERMINATION OF THE WINNER AND PRIZES
First Prize:
- VIP Pass to the Grand Prix de France: backstage access and meeting with pilots
(autograph signings).
Estimated value: 1000€
No exchange value for these prizes can be requested, either in cash or in any other form, and no
exchanges are permitted.
ARTICLE 5: LITERARY AND ARTISTIC PROPERTY RIGHTS
Each participant declares that all the elements composing the photo are royalty free.
Consequently, each participant undertakes to personally deal with any complaint, proceedings,
dispute or any action taken by any third party, whatever the basis, especially but in a nonrestrictive
manner: with regards to intellectual property rights (copyright, related rights, trade
mark law, design right) and/or personality rights and/or with respect to the elements composing
the photo that would be in breach of the laws and regulations in force, especially but in a nonrestrictive
manner in breach of public order, decorum, and not complying with the dignity of
human persons and private life.
ARTICLE 6: MODIFICATION AND CANCELLATION OF THE CONTEST
The Company reserves the right to cancel, shorten, prolong, suspend, modify or postpone the
contest any time if circumstances so require, without it incurring liability in these respects. Insofar
as possible, these modifications or changes shall be brought to the notice of participants in all
appropriate manners.
ARTICLE 7: REIMBURSEMENT OF CONNECTION FEES
Connection fees will be reimbursed within the limits of 3 minutes of connection, based on France
Telecom local communication rate in force as theses terms are drafted (0.16€/minute).
Participants that do not pay any connection fees (subscribed to unlimited plans, ADSL cable
subscribers) could not claim for any reimbursement.
Please address a written request to the Organizer to be reimbursed.
Participants must clearly indicate in their application their first and last names, complete address,
provide their bank details and attach a copy of their internet bill with highlighted connection dates
and hours.
Claim for connection fees reimbursement should be sent via a letter stamped at economic rate
(less than 20g).
ARTICLE 8: NOMINATIVE INFORMATION
All the information which participants transmit on the form is solely intended for the Company,
which will process it.
In accordance with the provisions of Article 27 of amended Act no. 78-17 of 6 January 1978 on
data processing, files and freedoms, the participants in this contest shall have a right of access,
rectification and deletion of data concerning them, by posting a request in this respect to the
organising company.
Personal data submitted when subscribing to Facebook are stored and used in compliance with
Facebook terms & conditions. The organising company is not responsible for processing data
submitted when subscribing to Facebook and invite participants to consult Facebook terms &
conditions.
ARTICLE 9: RULES OF THE CONTEST
These rules have been filed via www.depotjeux.com at COHEN-SKALLI-HOBA whose office is
located at 5 Avenue Gabriel Péri BP42 93401 SAINT-OUEN CEDEX.
The rules shall be sent free of charge to anybody asking the Contest Organiser for them.
The stamps required to send a letter asking for a copy of the rules shall be reimbursed at the
second-class tariff, on request.
ARTICLE 10: DISPUTES
Any dispute regarding the contest shall be made by return-receipted registered mail in a period of
ten days from its end (postmarked no later than that date). It shall be sent to the organising
company.
Any dispute that cannot be settled outside the court system shall be brought before the competent
Courts designated in accordance with the Code of Civil Procedure.
ARTICLE 11: COMPANY LIABILITY
These rules are subject to French law.
Should a dispute arise concerning the organisation of this contest or its follow-up, the parties shall
strive to resolve it amicably. Any dispute that cannot be resolved amicably shall be brought before
the court of Bobigny.
The Company cannot be held responsible if the winner cannot be reached through no fault of its
own.
The Company cannot be held responsible if, due to force majeure outside its control, this contest
were partially or totally modified, postponed or cancelled. No exchange value for the contest
prizes shall be offered as compensation.
As it is a free contest without any purchasing obligation, it is expressly agreed, pursuant to Article
1152 of the Civil Code, that the Company's liability shall be limited – if it were sought – to a lump
sum comprised between one euro and the average commercial value of the highest prize of this
contest.
