TERMS AND CONDITIONS FOR
PRINGLES SPIRIT OF SUMMER 2013 COMPETITION
1.This competition will be governed by these Terms and Conditions and entrants agree that they have read and understood these Terms and Conditions and will be bound by them.
2.Entrants may enter the competition online via the URL www.mtvpringles.com or www.mtv-pringles.com and by answering the multiple choice question. Costs to enter the competition via the Internet may vary so please check with your network operator for current charges. Entrants should seek the permission of the person paying the bill before entering.
3.The closing date for entries is 17:00pm on 1 July 2013.
4.This competition is open to residents of the following listed countries only: ◦Germany;
◦Austria;
◦Switzerland;
◦the United Kingdom;
◦Republic of Ireland;
◦France; and
◦Spain,
aged 18 and over, excluding employees and immediate relatives of employees of MTV Networks Europe (the “Promoter”) and/or Pringles Internaltion Operations s.a.r.l, (“Pringles”) or of their respective parents, subsidiaries or affiliated companies or any other person professionally connected with this competition.
5.All entrants shall be responsible for ensuring that their entry and/or acceptance of the prize(s) does not contravene any local laws or regulations in the country in which they are resident. This competition shall be void where prohibited or restricted by law.
6.One (1) entry per person. Multiple entries will be void and the entrant disqualified. All entries must include name, age, address, (including postcode), telephone number of entrant and answer to the question.
7.Please take care when entering the competition and make sure that your entry is complete. Entries that are incomplete or that cannot be clearly viewed or read will not be entered into the competition.
8.One (1) winner will be drawn from each of the countries listed above and will be the first entry randomly drawn from all valid entries received.
9.Each winner will receive a trip to the Benicassim Festival (“FiB Festival”) in Spain for the winner and three (3) guests and includes: ◦Return economy travel (flights or train travel depending on the winner’s location) to Barcelona or Valencia
◦VIP tickets to the FiB Festival, including access to the VIP area
◦Four (4) nights accommodation in one (1) pre-setup tent in a designated Pringles area, as part of the general festival camping area
◦Return transfers between Barcelona or Valencia airport and the FiB Festival
◦Drinks vouchers amounting to €125 (to be used at the FiB Festival only)
◦Standard travel insurance excluding any pre-existing medical conditions
◦On-site travel guide support.
The prize value is approximately €5,275.
All guests must all be aged 18 or over at the date of travel.
The trip will take place over five (5) days between 17 July 2013 and 22 July 2013. The exact dates of travel will be determined by the Promoter. No alternative dates shall be available. The departure airport/train station used will be dependent on the direct availability from each winner’s nearest international airport/train station, which may not necessarily be the closest.
The winners and the winners’ guests must hold a valid passport and/or any other necessary travel documentation (including, without limitation, visas where necessary) to travel to Spain. For the avoidance of doubt, where visas are required, these must be arranged with the relevant Embassy at the individual winner’s, or the winner’s guest’s own expense.
TRAVEL DATES AND/OR NAMES OF TRAVELLERS CANNOT BE CHANGED ONCE THE TRAVEL HAS BEEN BOOKED.
10.For the avoidance of doubt, the prizes do not consist of anything other than expressly set out in paragraph 9 above and no additional costs (including, without limitation, spending money, meals, additional transport costs and expenses) are included. THE WINNERS AND THE WINNERS’ GUESTS MUST ARRANGE TRANSFERS TO AND FROM THE DEPATURE AIRPORT/STATION THEMSELVES.
11.All components of the prize must be taken together or otherwise are deemed to be fortified. Each winner and their guests must travel together on the same itinerary. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
12.The winners are responsible for all applicable taxes and expenses not specified in the prize description.
13.The winners will be selected and notified by telephone during the week commencing 1 July 2013 by the Promoter. Each winner will need to provide the Promoter with their details and the details of their guests (including full name, date of birth, copy of passport/identification card and contact details).
14.In the event that the Promoter cannot for any reason contact any winner by 5 July 2013 the Promoter reserves the right to draw another winner.
15.The Promoter’s decision is final with respect to any aspect of the competition, including the determination of any winner of a prize. No correspondence will be entered into.
16.Entrants agree that the Promoter and Pringles may use the entrant’s entry, name and/or likeness, voice, photographs and/or video footage of the entrant, biographical information provided by the entrants and/or any statement made by them concerning the competition and/or the prize(s) in connection with publicizing the competition, in any and all media in perpetuity throughout the world as the Promoter and/or Pringles in their sole discretion see fit and without further consent or payment.
17.By entering this competition, all entrants hereby grant the Promoter (or the Promoter’s designee) the exclusive right to film, tape, sound record and photograph all their activities in connection with the competition and (if applicable) any prizes. Everything filmed, taped or recorded by the Promoter (or the Promoter’s designee) shall be known as “Footage”.
18.All entrants hereby irrevocably and unconditionally assign to Pringles with full title guarantee (and by way of present assignment of present and future rights) all intellectual property rights in any “Footage” throughout the world for the full unexpired period of such rights and all renewals, reversions and extensions of such period as may be provided under any applicable law throughout the world.
19.All entrants hereby irrevocably and unconditionally waive in favour of the Pringles, Pringles’ affiliates and their licensees, assigns and successors in title, all moral rights in any “Footage” to which he or she is, or may at any time in the future be, entitled.
20.The Promoter reserves the right to select an alternative winner in the event that the Promoter has reasonable grounds for believing that any selected winner has contravened any of these Terms and Conditions.
21.The winners may be required to provide a written acknowledgement of acceptance of all terms and conditions of the competition prior to receiving their prize.
22.The Promoter can accept no responsibility for entries lost, delayed, misdirected, damaged or undelivered. Incomplete and/or illegible entries will be disqualified. The Promoter shall not be responsible for technical errors in telecommunications networks, Internet access or otherwise preventing entry to any competition.
23.The prizes are as stated and are non-transferable. No cash alternatives will be offered. If due to circumstances beyond the Promoter’s control the Promoter is unable to provide any stated prize(s), the Promoter reserves the right to award a substitute prize of equal value. All prizes are subject to the additional terms and conditions of the manufacturer or supplier.
24.No purchase necessary.
25.The Promoter shall not be liable to the winners and/or any guests for any loss or damage howsoever caused (whether in contract, tort or statutory duty or otherwise) arising out of or in connection with the competition and/or prize other than death or personal injury caused by negligence of the Promoter and/or the Promoter’s personnel and/or deceit or fraud by Promoter and/or Promoter’s personnel.
26.The Promoter shall not be liable for any delay in performing or partial or total failure to perform any of its obligations to the winners and/or any guests under these Terms and Conditions if such delay or failure is caused by circumstances beyond its reasonable control including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation as a result of war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes or arising without limitation out of or in connection with (i) the activities of third party event organisers; (ii) any form of transportation (including but not limited to flights, trains, coaches, buses, ferries, taxis or cars); and/or (iii) by third parties providing accommodation included in the prize. For the avoidance of doubt, the affected winner and/or any guests shall be solely liable for any additional costs incurred as a result.
27.Nothing in these Terms shall limit the Promoter’s liability for death or personal injury caused by negligence of the Promoter and/or deceit or fraud by Promoter.
28.Each provision excluding or limiting liability is to be construed separately and will apply and survive even if for any reason any of the other provisions are held to be inapplicable or unenforceable in any circumstances. Each of the provisions excluding or limiting liability will remain in force notwithstanding any termination of these Terms.
29.Only entries from individuals will be accepted. Any entries that the Promoter believes have (a) been made via participation in a syndicate or (b) via any form of machine assisted intervention enabling computer generated multiple entries, will be disqualified. The Promoter reserves the right to discount multiple entries from the same IP address.
30.The names of the winners can be obtained by sending a stamped, self- addressed envelope to MTV Networks Europe, Be Viacom Pringles Spirit of Summer 2013 Competition, 17-29 Hawley Crescent, London, NW1 8TT, for one (1) month after the competition closes.
31.Any personal information, including without limitation, the entrant's name, age, address (including postcode), telephone number and/or email address will be used solely in connection with this competition and for any purpose for which the entrant specifically opts in and will not be disclosed to any third party except for (a) the purpose of fulfilling the prize(s) where applicable and (b) for any purpose for which the entrant specifically opts in. Any personal information held by the Promoter in respect of any competition will be held on record for a reasonable period to fulfill the purpose for which such personal information was collected. If an entrant gives the Promoter permission to pass on their personal information to a third party then this shall no longer be the responsibility of the Promoter and shall be subject to the privacy policy of that third party.
32.All entrants agree to be bound by these Terms and Conditions, which may be amended or varied at any time by the Promoter on notice.
33.These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and the courts of England shall have exclusive jurisdiction in relation to any disputes arising therefrom.
