RESULTIME GAME
ARTICLE 1: ORGANISATION
RESULTIME, SAS, capital EUR 460,547.00, registered office 127 rue d’Aguesseau, 92100 Boulogne-Billancourt, France, listed on the NANTERRE Trade and Companies register under company number 808 650 758, hereinafter referred to as the “Organising Company”, shall, between 11.00am on 28 October and 11.59pm on 8 November 2021 (time in mainland France), organise a free competition entitled “Resultime Game”, (hereinafter referred to as the “Competition”) according to the terms and conditions laid out in these rules.
The Competition shall be accessible from 11.00am 28 October until 11.59pm on 8 November 2021 (time in mainland France) from the Organising Company’s Instagram page at the following address : https://www.instagram.com/resultime/ or via the Instagram application at the same address (hereinafter referred to as the “Website”) and on Facebook page at the following address: https://www.facebook.com/ResultimeFR/ or via the Facebook application at the same address (hereinafter referred to as the “Website”).
The Organising Company shall expressly inform Participants that Instagram and Facebook are not in any way responsible for sponsoring or managing the Competition. Instagram and Facebook cannot be held liable for any breach of the legality of its terms and/or conduct should this occur.
ARTICLE 2: CONDITIONS OF PARTICIPATION
Participation in this Competition is open to any natural person aged 18 or over at the start of the Competition with access to the Internet and an Instagram account from that date (hereinafter referred to as the “Participant”), with the exception of:
? Employees of the Organising Company, its shareholders and subsidiaries or agents, as well as their families (same surname, same postal address, same electronic address).
? Organisations and entities involved in the development of the Competition, as well as their families, including partners and, in a general sense, anyone involved in the development of the Competition, either directly or indirectly.
The Competition is limited to one entry per person and per household (same surname, same first name, same address and/or mobile phone number and/or Instagram account and/or e-mail address). Multiple entries (including entries by one Participant using different or alternative e-mail addresses) will not be accepted.
The Organising Company reserves the right to void entries made by any individual who is found to have entered multiple times using different identities, or who has supplied inaccurate information.
The Organising Company reserves the right to cancel at any time and without prior notice the participation of any Participant who has not complied with the provisions set out within these rules. It is expressly forbidden for the same natural person to play using a Participant account opened for the benefit of another person.
The Organising Company reserves the right to carry out any checks necessary with regard to the identity, age and address of the Participants. Any false or fraudulent information will result in participation being rendered null and void.
ARTICLE 3: PARTICIPATION
The only way to participate in the Competition is via the Organising Company's Instagram page and the Organising Company's Facebook page.
Participation in this Competition implies full and complete acceptance of the provisions set out within these rules and Instagram and Faebook’s general conditions of use. The Participant also acknowledges that he or she is aware of Instagram's privacy policy, which can be viewed directly on the Instagram website.
The Participant is prohibited from implementing or seeking to implement any participation process that is not strictly compliant with the principles of these rules.
Competition period: from 11.00am on 28 October 2021 until 11.59pm on 8 November 2021 (time in mainland France)
To participate in the Competition, the Participant must:
1. Connect to his or her personal Instagram account by entering his or her e-mail address and password.
2. Follow the @resultime account.
3. Like the post from 28 October 2021.
4. Comment on the post from 28 October 2021, tagging three 3 friends.
And/or :
1. Connect to his or her personal Facebook account by entering his or her e-mail address and password.
2. Follow the resultime Facebook page.
3. Like the post from 27 October 2021.
4. Comment on the post from 27 October 2021r, tagging three 3 friends.
The Organising Company reserves the right to modify the terms of participation through communicating this on Instagram.
If the Participants comment several times on the post, only the first comment will be taken into account for participation in the Competition (as per the time of posting).
Content shall be rejected outright where it falls under the following, but without this list being exhaustive :
• indecent, vulgar, pornographic, racist or paedophilic in nature, or damaging to children;
• defamatory, offensive or slanderous in nature with regard to a third party, natural persons or legal entities;
• political in nature and/or judged to be sensitive by the Organising Company;
• or that promote a third-party brand;
• constitute a violation of privacy, third parties’ image rights and/or a conflict with the applicable laws;
• contrary to good conduct and/or public order;
• reproduce an element subject to intellectual or industrial property rights, such as, but without this list being exhaustive, an original work, a brand, registered design, patent, etc.
In more general terms, any entry that is incomplete or that contains false, incorrect or inaccurate identity or address information, or that does not correspond to the stipulations made will result in the entry being rendered void.
Any content likely to harm the image and/or the credibility of the Organising Company’s advertising message and/or its brands will be rejected.
The Participant is required to inform the Organising Company of any change to his or her data.
The Participants grant permission for all checks regarding their identity, date of birth and address. The Participant shall refrain from engaging in any manner of participation that does not conform to these rules. Any Participants who attempt to enter by means of automatic competition entry bots, programs developed for automatic competition entering, use of information, e-mails generated automatically and, in a broader sense, by any and all means that do not respect the equal chance each Participant has, will be eliminated automatically.
Not respecting the conditions of entry as stipulated in the rules shall result in the entry being rendered null and void.
ARTICLE 4: DRAW AND PRIZES
On 9 November 2021 the Organising Company will name the 3 (three) Participants who have met the conditions of entry on Instagram (hereinafter “the Winners”) and the 3 (three) Participants who have met the conditions of entry on Facebook (hereinafter “the Winners”.
In the event that one, or more, of the same Participant(s) is drawn on both Instagram and Facebook, the Organizing Company will conduct a new drawing until the three Winners drawn on Instagram are different from the three Winners drawn on Facebook.
The draw may not be contested in any way.
The Winners will be announced on 11 December 2020 by the Organising Company via replies to the comments posted by the Winners. The Organising Company will contact the Winners via private message on Instagram.
Participants who have not won will not be contacted, even in reply.
The 6 (six) Winners will be offered two prizes:
- 1st prize: 1 (one) Collagen Serum Gel RESULTIME 50 ml with an indicative unit value of 59,90 euros including tax.
- 2nd prize: 1 (one) RESULTIME Collagen Wrinkle Filler Cream with Plumping Collagens 50 ml with an indicative unit value of 59.90 euros including tax.
Participants are informed that the prizes will be sent within 8 (eight) weeks after the announcement of the Winners.
ARTICLE 5: PRESENTATION OF THE PRIZE
To receive the prize, the Winner must confirm via private message on Instagram and on Facebook that they have received the message from the Organising Company confirming their win, and do so within 72 hours, calculated from November 9, 2021.
The prizes will be sent by post within 8 (eight) weeks of November 9, 2021 to the address provided by the Winner via private message.
The Participants grant permission for all checks regarding their identity and address.
The Organising Company reserves the right, should circumstances demand, at any time to replace the prize with an equivalent prize of equal value.
The Organising Company shall not be required to award the prize under the following conditions:
- The Winner does not confirm receipt of the message confirming that they have won and does not pass on the information requested by the Organising Company within 72 hours of this email being sent,
- When entering, the Winner entered information that was inaccurate or incoherent,
- Or the Winner has not complied with these rules.
The prize shall not be subject to dispute and no equivalent cash value will be offered, nor will any part of the prize be exchanged or replaced at the Participant’s request.
Any prizes that cannot be sent due to imprecise or incomplete postal information, a lack of a response within the 72-hour time frame specified, or for any other reason beyond the control of the Organising Company, shall not be reallocated.
Any packages returned to the Organising Company due to not having been accepted/claimed by the Winner will not be reissued.
ARTICLE 6: PUBLICITY
6.1 Image rights
The Participants freely permit the Organising Company to use their first name, surname and/or pseudonym and post for the purposes of communications around the Competition. This authorisation is granted for use across all communications channels (print, audiovisual and digital) used for publishing information about the Competition, for a period of 2 (two) years from the start of the Competition, and applicable across the whole world.
6.2 Copyright
The information entered online by the Participants can also be utilised by the Organising Company.
In light of this, the Participants freely cede the right to the reproduction, representation, adaptation, or cause to be represented or adapted, without quantitative limitation, of the content that they have submitted as part of participating in the Competition, for their use in the following manner:
• type of use: for publicity-related, commercial or promotional purposes,
• channels: across all communication channels (the Internet websites belonging to the Organising Company or its affiliated companies, including social media/print/audiovisual channels),
• applicable region: global,
• duration: 2 years, calculated from the start date of the Competition.
The Participants freely permit the Organising Company to use their first name, surname and image for the purposes of the communications around the Competition. This authorisation is granted for use across all communications channels used for publishing information about the Competition, for a period of 2 (two) years from the start of the Competition, and applicable across the whole world.
6.3 Guarantees
The Participants certify that they are the sole authors of the content that they submit in the course of participating in the Competition, and that this content does not include any element that could give rise to the rights of third parties (copyright, image rights, etc.).
The Participants shall freely and without argument allow the Organising Company to utilise the rights ceded hereunder, so that the Organising Company may make use of the content under the conditions defined herein without being hampered in any way by concern over their use.
In particular, they shall safeguard the Organising Company against any claim by third parties of any nature whatsoever regarding the use of the content in accordance with the conditions defined herein.
ARTICLE 7: THE ORGANISING COMPANY’S RIGHTS AND RESPONSIBILITIES
The Organising Company assumes no responsibility whatsoever in the event of a failure in the Internet connection preventing access to the Website or the Competition running properly.
The Organising Company also assumes no responsibility in the event of one or several Participants being unable to connect to the Website, or participate as a result of any issue or technical fault linked to network congestion in particular, or due to malicious acts.
Insofar as the Internet is not a secure network, the Organising Company shall not be held responsible for contamination by a potential virus or intrusion by a third party into the terminal systems belonging to Participants, and it accepts no responsibility with respect to the consequences of Participants connecting to the network via the Website for reasons that are not directly and exclusively attributable to the Organising Company.
The Organising Company shall not be held liable for any damage caused to Participants, their computer systems or the data stored there, nor for any consequences that may ensue with regard to their personal or professional activities, except in the case of the Organising Company being directly at fault.
The Organising Company assumes no liability whatsoever with regard to the content and use of the “Instagram” Internet site and the “Facebook” Internet site.
The Organising Company assumes no liability for any damage, theft or loss occurring during the course of the delivery, or in the event of delivery problems or loss of e-mail.
The Organising Company accepts no responsibility in the event of any incident that may occur from using or enjoying the prize that has been won.
The Organising Company assumes no liability in the event of the Participants using the information of persons who have not consented to the use of their data.
The Organising Company reserves the right, should circumstances demand, to curtain, extend, modify or cancel this Competition, without being held liable for so doing. Any modification to the terms and conditions of this Competition, its suspension or cancellation shall be communicated to Participants via the same means as those used to promote the Competition and/or on Instagram and Facebook.
Lastly, the Organising Company reserves the right to replace a prize won with a prize of equal or greater value, especially, without this being exhaustive, in the event of a stock shortage of the items originally planned, or any other unforeseeable, uncontrollable or external event that makes it impossible to deliver the items planned within a reasonable time frame. Under no circumstances may the Winners demand financial compensation.
ARTICLE 8: FRAUD
The act of participating in this Competition implies full and complete acceptance of these rules in their entirety.
Any misleading or false statements or any fraud will lead to the Participant being disqualified, even if the fraud is recorded after the closure of the Competition and/or after the Winners have been named. The Organising Company reserves the right to pursue the perpetrators of fraud before the competent courts.
The Organising Company shall be at liberty to cancel all or part of the Competition if it appears that instances of fraud have intruded in any form whatsoever, especially through computer-based means, in the context of participating in the Competition or determining the Winners. In this hypothetical situation the Organising Company reserves the right to not allocate the prizes to those guilty of fraud and/or to pursue the perpetrators of this fraud before the competent courts.
In accordance with the laws governing literary and artistic property rights, or related rights, the reproduction and representation of all or part of the Competition’s constitutive elements is strictly prohibited.
ARTICLE 9: MISCELLANEOUS
The Organising Company’s Activation, Communication & Social Media management team will be able to answer questions on the rules of participating in the Competition.
These rules may be addressed, free of charge, to anyone requesting them in writing from the following address: Direction Activation, Communication & Social Media, 127 rue d’Aguesseau, 92100 Boulogne-Billancourt, France.
Any disputes concerning the interpretation and/or any situations not foreseen by these rules shall be decided by the Organising Company, whose decisions shall be final and not subject to appeal.
No dispute or complaint shall be taken into consideration after 1 (one) month following the closing date of the Competition.
These rules are subject to French law.
ARTICLE 10: CNIL/SUNSHINE
10.1 In accordance with the legal provisions on the transparency of links with health professionals; the Organising Company shall inform each Participant that, where the Winner is a health professional, the benefits that each Participant receives from the Organising Company in the context of this operation shall be published on the Internet.
10.2 The data collected with regard to each Participant may be subject to computer processing for possible publication and thus a declaration to the Commission Nationale de l’Informatique et des Libertés [French Data Protection Authority]. In accordance with the “information technology and civil liberties” law of 6 January 1978, as modified and with the General Data Protection Regulation no.2016/679 dated 27 April 2016, each Participant benefits from the right to access, rectify, object to and erase their data where legitimate reasons exist and the right to data portability of his/her data from 25 May 2018 onwards.
Individuals who exercise their right to have their data erased before the end of the Competition shall be considered to have withdrawn their entry.
