FOR THE 2010 MTV EUROPE MUSIC AWARDS ONLINE COMPETITION “FAN Award”
Suzuki International Europe GmbH hereby invites you to participate in the FAN Award Competition (“Competition”). As participant of the Competition all you have to do is to register, to submit a complete Fan Award application form and to upload images and / or a Youtube video showing you as the biggest music fan.
The prize is a trip for you and a company (max. 1 person) of your choice (in total max. 2 persons, all over 18 years) to the MTV Europe Music Awards 2010, including two tickets for the MTV Europe Music Awards in Madrid on 7th November 2010 and the Aftershow Party. For organizational reasons, the deadline to enter to win the grand prize is October 17, 2010, 10:00 (CET).
The Participant accepts and agrees that the following rules apply without limitation to the Competition and your use of this web-site. In addition, any instructions on how to enter this Competition form part of these terms and conditions.
This Competition is without any obligation to make a purchase for Entry.
§ 1 Registration
Each participant (“Participant”) may enter the Competition by visiting the www.swift-fanaward.com website (“Web-site”) and submitting an application.
Each participant must register and then completely fill out the required entry form (“Entry”) consisting of personal information, a short profile, your URL, one image and if available further images and / or a (song) Youtube video (“material”) which do not fall under any third party’s rights, in particular copyrights.
The website www.swift-fanaward.com and the submitted materials will be cleared until 31.12.2010.
Only one (1) Entry in the online Competition per Participant will be accepted.
Each Entry must include correct information regarding Participant’s name and surname, age, gender, address (including town and postal code), resident country, mobile phone number, participant's e-mail address as well as min. 1 uploaded image and optional further images and / or provide a video which will be embedded from his / her youtube account. In the event complete and correct information is not provided, the Entry will be considered incomplete and therefore invalid. Invalid forms will not be accepted as valid Entries to the Competition.
By registering and completing the application form, the Participant is supplied with a personal user profile (consisting of user name, city/country, image and profile) which the Participant may change to suit his or her own liking. The user profile will be viewable for all visitors to the Website www.swift-fanaward.com
§ 2 Voting
The online community can view and evaluate all entries on the website without the necessity of registering. During the voting phase the public user may give his or her vote for up to 10 different entries per day by clicking the thumps up button. Negative feedback is not possible. A Participant may not vote for his / her own entry. The status of votes is made visible by a voting bar diagram.
At the end of the competition, October 29th 2010, 10:00 (CET) a jury consisting of:

creativity
originality
credible performance of “biggest music fan qualities”

The jury shall make its decision in private by way of a simple majority vote of jury members. The jury’s decision is final and binding.
§ 3 Organizer
This Competition is organized and hosted by SUZUKI INTERNATIONAL EUROPE GMBH, Suzuki-Allee 7, D-64625 Bensheim, Germany (“Suzuki”).
This Competition shall be subject to local availability and is only available in the following countries: Albania, Austria, Belgium, Bosnia, Bulgaria, Croatia, Czech, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Israel, Latvia, Lithuania, Macedonia, Malta, Montenegro, Netherlands, Norway, Polska, Portugal, Romania, Serbia, Slovenia, Spain, Sweden, Switzerland, United Kingdom and Ukraine. Suzuki Italia S.p.A. Via Ettore De Sonnaz, 19 – 10121 Torino (Italy) is organizer of the Italian Fanaward Competition (applicable Terms and Conditions available on www.swift-fanaward.it ).
§ 4 Schedule
Competition launch: 6th September 2010 (10:00 hrs CET)
Closing date for entries: 17th October 2010 (10:00 hrs CET)
Online voting: 18th October 2010 – 29th October 2010
Jury voting: 29th October 2010 – 30th October 2010
Final decision and winner announcement: by 2nd November 2010
§ 5 Group of Participants
The Competition is open to residents of European countries where this Competition is locally available provided the Participant is of minimum 18 years of age.
However, employees and immediate relatives of employees of Suzuki or of its respective parent company, subsidiary or affiliated companies or any other person connected with this Competition are excluded from participation.
Participants cannot be legal entities.
All Participants are responsible for any costs or expenses incurred by them as a result of participation in the Competition.
§ 6 Disqualification
All entries are subject to the inspection and approval of the administrators of the website www.swift-fanaward.com
Discriminating, pro violence, pornographic, illegal and other material contents which offend common decency will be disqualified from the competition.
The organizer has the right to disqualify participants who manipulate or attempt to manipulate the participation process and the competition and/or breach these competition rules and/or otherwise attempt to fairly or unfairly influence the competition (in particular by way of interference with, threatening of and/ or harassing of other competition participants or the organizer's employees).
Upon agreeing to these terms and conditions, the Participant also agrees not to violate any third party’s rights by uploading any material or media falling under 3rd party’s rights, in particular copyright restrictions. If such a violation occurs, the Participant can be disqualified.
The administrators also reserve the right to delete Participant’s profile and content and ban Participant’s participation at any time in the event of the violation of these terms and conditions by the Participant.
§ 7 Prize winning and prize giving
The winner of the first prize (“First Prize” as described below) will be selected by the Judges. The winner will be chosen from among all valid entries submitted by 17th October 2010.
To receive the First Prize the Winner must be willing and able to attend the MTV Europe Music Awards in Madrid from 7th November to 8th November 2010 and be available for travel during the period from 7th November to 8th November 2010 (the “Event”).
The dates of the Event may be subject to change due to rescheduling of the event beyond Suzuki’s reasonable control. In the event of a rescheduling of the Event the winner will be offered the First Prize on alternative dates instead, such dates to be communicated to winner by Suzuki within reasonable time from rescheduling. If Participant of winning Entry is not available for travel on such alternative dates, Suzuki reserves the right to select the next runner-up as winner instead, in which case the other Participant forfeits his right to the First Prize.
The First Prize will include and cover the following for the Winner and his/her company:
two (2) tickets to the 2010 MTV Europe Music Awards in Madrid and official MTV Aftershow Party,
two (2) two way economy flights to Madrid Airport: from the nearest airport with tourist or economy flights based on Winner’s permanent address stated in the Entry form,
one (1) night accommodation (double room) at a hotel determined by Suzuki including breakfast,
all transfers between airport and hotel and hotel and the Event location (including to Aftershow Party locations).
Winner and company must have valid travel documentation such as passport (minimum validity six months from outbound travel date) or visa as applicable and comply with any customs, immigration or other regulatory requirements for full and unlimited attendance. Winner must also have valid and appropriate travel insurance. Any costs for obtaining required travel documentation or insurance shall be borne by Winner and will not be reimbursed by Suzuki.
Winner and company are responsible for all costs not expressly described above. This includes, without limitation, costs such as transportation to and from the airport in the Winner’s city of residence, additional accommodations if required, meals not specifically referenced herein, gratuities, telephone calls, taxes and items of a personal nature.
The Prize is as stated and is non-transferable and cannot be exchanged. No cash or credit alternatives will be offered. If due to circumstances beyond Suzuki’s control, Suzuki is unable to provide the stated Prize, Suzuki reserves the right to award as substitute a Prize of equal or higher value.
The Winner and company agree and accept that the terms and conditions of other parties (airline, travel agency, hotel, transportation provider etc) may be additionally or exclusively applicable (whether in part or in whole) while attending the Event or for the Prizes.
§ 8 Notification of winner and publication of winner name
The winner will be notified by telephone or email by 30th October 2010.If the winner is not available via telephone or will not react for more than a 48 hours period – commencing at the time when notification of the win is provided - or if the winner contravened any of these Terms and Conditions, he or she shall lose his or her entitlement to the prize. In this case, the prize goes to the Participant who is judged by the jury to have submitted the second-best FAN Award material.
Participants of the Competition who are not winners will not be notified upon request.
Taxes, duties, levies and other costs (incidential, direct or indirect) incurred as a result of participation and winning of the prize have to be borne solely by the winner.
§ 9 Liability
Suzuki shall not be liable for incorrect or incomplete records of Participant and competition data, or the failure to record, store or process such data, for reasons over which Suzuki has no control. If irregularities occur in the voting process - for example as a result of server or software problems - Suzuki shall make a final and absolute decision as regards the winner at their own discretion.
§ 10 Rights
By submitting the material, every Participant accepts the competition rules. He or she bindingly and irrevocably guarantees that the uploaded material is his or her own work and that he or she holds all copyrights, rights of use and enjoyment and other related rights, and the material does not infringe third party rights.
The Participant thus indemnifies and holds harmless Suzuki upon first request of Suzuki or as soon as Participant becomes aware of it, whatever occurs earlier, from all third party claims arising from the uploaded material, especially any infringement of third party rights related to the material. If material is created by more than one person, all copyright-reserving persons must be named and their consent verified. Participants are liable for the validity of the information that they provide.
By submitting the material, the Participant grants under the condition that he / she wins the competition Suzuki International Europe GmbH the exclusive rights to all known types of use (not limited with regard to time, territory and content) to the created material. This includes, in particular, but without limitation the right to duplicate, disseminate, exhibit or make the material available to the public, especially for promotional purposes. The Winner agrees to sign a consent form regarding the promotional use of the material which shall be based on adequate consideration and conditions.
Suzuki reserves the right to make any necessary changes to the material for objective and reasonable grounds. Suzuki is also permitted to combine an own logo with the winning material. Suzuki receives the right of use with regard to the changed and / or combined winning material as granted in the paragraph above.
