Terms & Conditions

1. The organiser

The organiser of the Masters of Photography 2013 competition is The Macallan Distillers Ltd. Employees of The Macallan and its group companies, and any of the official partners, sponsors, or associates of The Macallan relating to the competition and their families are not eligible to enter this competition.

2. Eligibility

The competition is open to amateur and professional photographers of all countries and nationalities who have access to the internet, with the exception of some USA States. Entrants must be of legal drinking age in the country in which they are accessing this site to enter this competition and be eligible to win.

In the USA the competition is open to legal residents of the United States, other than current residents of Alabama, Indiana, Maine, Maryland, Michigan, Montana and West Virginia. This competition is void in the foregoing States and wherever prohibited by Federal, state or local law. Entrants, who are legal residents of the United States, must be twenty-one (21) years of age or older as of the date of commencement of the competition 24th October 2013 to enter this competition and be eligible to win.

By entering the competition, you agree to be bound by the following rules, and also The Macallan terms and conditions of website use and its privacy policy. Entries must be submitted by an individual (not via any agency or similar).

Images uploaded to the competition website should not exceed the maximum size of 2MB, in JPEG format. If your image is voted to the shortlist, you will be asked to submit a high-resolution version or proof of ownership.

An image that has won a prize in a major national or international competition (one receiving more than 500 images) or that has been entered in such a competition where the results are still pending, is not eligible for entry. There is no entry fee associated with the Masters of Photography 2013 competition. All entrants agree to participate in any publicity in connection with this competition as required and to the use of your name and likeness for the purpose of promotion and publicity.

Minor burning, dodging and/or colour correction is acceptable. Hand tinting is acceptable, as is cropping. Fish-eye lenses are acceptable. High dynamic range images (HDR) and stitched panoramas are acceptable only if the combined parts are all made around the same time. Any changes to the original photograph not itemised here are unacceptable and will render the photograph ineligible for a prize.

The photograph must not, in the sole and unfettered discretion of the Sponsor, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content.

The Macallan reserves the right in its sole discretion to disqualify any entrant it finds to be: (1) tampering or attempting to tamper with the entry process or the operation of the contest; (2) violating the official rules; (3) violating the terms of use; or (4) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. Any false or misleading information provided by any entrant may result in disqualification.

The Macallan is not responsible for any typographical or other error in the printing of the contest offer, official rules, or administration of the contest. The Macallan accepts no responsibility for any entries that are lost, delayed, damaged, stolen, misdirected, or mislaid. The Macallan is not responsible for electronic transmission errors resulting in omission, interruption, deletion, or delay in operations or transmission, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind.

3. Legal requirements

By submitting an entry into the competition, you warrant to The Macallan that the entry is wholly original to you and not wholly or substantially copied from any other material and that the entry does not defame, cause injury to or invade the privacy of or otherwise infringe or violate any statutory, common law, regulatory or intellectual property rights of any third party. You agree to fully indemnify The Macallan and any of the official partners, sponsors or associates of The Macallan relating to the competition in respect of all royalties, fees and other monies owing to any person by reason of your breaching this rule.

4. Entering your photographs

Entries must be submitted in accordance with the instructions set out on the Entry page.

5. Master Class Submissions

All submissions must be entered before 5.00pm GMT, 6th March 2014.

6. Judging

A final shortlist of images will be announced following the closing date of the competition. The Macallan will appoint a judging panel to determine the winning and runners-up images based on the final shortlist. The decision of the judges in deciding the winners is final and The Macallan will not enter into any correspondence regarding the judging or organisation of the competition.

7. Notification

Winners and runners-up entrants will be announced on the competition website on 14th April 2014.

8. Prizes

1. The Master of Photography 2013 winner.

The overall winner of the Master of Photography 2013 competition will win a fabulous Leica X Vario camera (worth £2,000).

2. Second prize.

The runner-up will receive the brand new Leica C digital compact camera in dark red (worth £550) and a Macallan ice ball maker and matching glassware (worth £700).

2. Third prize.

The third placed will receive a Macallan ice ball maker and matching glassware (worth £700).

Total estimated retail value of all prizes awarded is approximately £3950.

The Macallan reserves the right to change or add to the prizes and substitute with a comparable alternative due to unforeseen circumstances. Any changes will be posted on the competition website at www.themastersofphotography.com. Prizes are non-transferable.

At the point of notification of winning entries, the winners must supply full postal address information and such other information The Macallan may require for the purpose of sending out the winners prizes. Once address details have been supplied, winners should allow 28 days for receipt of their prizes.

9. Copyright

The entrant must be the sole author and owner of copyright, intellectual property, and all other proprietary rights in all pictures entered. It is the legal responsibility of the entrant, and not The Macallan, to ensure they comply with these ownership and copyright requirements and own the rights to reproduce their images. Entries that do not fulfil these criteria will be deemed ineligible and disqualified. The Macallan does not make any claim on the copyright of your images. The photographer will retain copyright and where an image or images are reproduced, the photographer will be credited.

10. Reproduction of entries

By entering your images into the competition, you grant to The Macallan and any of the official partners, sponsors or associates of The Macallan relating to the competition a worldwide, perpetual, non-exclusive, irrevocable licence to reproduce any of the images for any purposes in connection with promoting the competition including, but not limited to, the following purposes:

1. Judging the competition

2. Voting

3. Inclusion within the competition website, TheMacallan.com website, or similar print or digital media published by The Macallan

4. Displaying the winning and runners-up entries at public exhibitions promoting the competition

5. Inclusion within marketing and promotional materials (including emails, websites and press packs) for the competition and / or any exhibition

6. Sub-licensing the entries to the press for reproduction in connection with the competition and any exhibition

7. Allowing viewers of the Website to view images on a computer screen, PDA or mobile telephone and store such pages in electronic form for their personal, non-commercial use

We do not claim unlimited licence for The Macallan or any of the official partners, sponsors or associates of The Macallan relating to the competition to reproduce your images outside of the terms set out above. Where image reproduction is unrelated to the promotion of the competition then permission and royalties will be discussed and negotiated with the photographer concerned.

All entrants must be able to supply a high-resolution image suitable for printing in media. Please note that your real name, rather than your username, will be used where your image is reproduced.

Right To Cancel Or Suspend Competition

If for any reason the competition is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of The Macallan that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this competition, The Macallan reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the competition. If The Macallan elects to cancel or terminate the competition, The Macallan will not retain any rights in the submitted photographs.

Data Privacy

Entrants agree that personal data, especially name and address, may be processed, shared, and otherwise used for the purposes and within the context of the competition and any other purposes outlined in these Official Rules. The data may also be used by The Macallan and any of the official partners, sponsors or associates in order to verify the participant's identity, postal address, and telephone number or to otherwise verify the participant's eligibility to participate in the competition. Participants have the right to access, review, rectify, or cancel any personal data held by The Macallan and any of the official partners, sponsors or associates by writing to The Macallan, West Kinfauns, Perth, Scotland PH2 7XZ.

Personal data will be used by the Macallan Distillers Ltd and its affiliates exclusively for the purposes stated herein.

General

1. These competition rules and competition are governed by English law. Any disputes arising between The Macallan and any third party in relation to these competition rules and/or a competition shall be subject to the exclusive jurisdiction of the courts of England and Wales (save that The Macallan shall be entitled to take action against a third party in any other jurisdiction).

2. If there is any inconsistency between any of the provisions of these rules, The Macallan terms and conditions of website use or The Macallan privacy policy, the provisions of these rules shall prevail.
