Règlement du jeu concours « Nice Hôtel Historique »
Article 1 : Société organisatrice
L’Office de Tourisme et des Congrès Métropolitain de Nice Côte d’Azur, Établissement Industriel et Commercial, loi du 11 Juillet 1964, N° Siret 395 235 047, Code NAF 633 Z, dont le siège social est au 455 Promenade des Anglais – Immeuble Nice Plaza – 06200, NICE, ci-après dénommée « Société Organisatrice », organise du Jeudi 27 Février (10h00) au Jeudi 6 Mars 2025 (16h00 heure française) un jeu concours «Nice Hôtel Historique»
Toute inscription en dehors de ces dates ne sera pas prise en compte.

Article 2 : Conditions de participation
2.1 La participation à ce jeu concours est ouverte à toute personne physique et majeure résidant en France métropolitaine (Corse incluse) et à l’étranger, à l’exception du personnel salarié de la société organisatrice.
2.2 Les personnes n'ayant pas justifié de leurs coordonnées et identités complètes ou qui les auront fournies de façon inexacte ou mensongère seront disqualifiées, tout comme les personnes refusant les collectes, enregistrements et utilisations des informations à caractère nominatif les concernant et strictement nécessaires pour les besoins de la gestion du jeu concours.
2.3 La participation est strictement nominative (limitée à une seule personne, mêmes nom et prénom, même adresse e-mail) sur la durée du jeu concours, il est donc interdit d’y participer sous plusieurs pseudos ou pour le compte d’autres personnes. La participation à ce jeu concours implique l’acceptation sans restriction ni réserve du présent règlement, et la renonciation à tout recours contre les décisions prises par les organisateurs de l’opération. A tout moment, le joueur est responsable de l’exactitude des informations communiquées.
2.4 La responsabilité des organisateurs ne saurait être engagée en cas de non réception de la participation, notamment en cas de coupures de communication, de difficultés de connexion, de pannes de réseau Internet survenant pendant le déroulement de l’opération.
2.5 Les inscriptions contrefaites ou réalisées de manière contrevenante au présent règlement entraînent la disqualification du participant. L’organisateur du jeu concours se réserve le droit de procéder à toute vérification pour l’application du présent article. La volonté de fraude avérée ou la tentative de tricherie démontrée d’un participant pourra être sanctionnée par l’interdiction formelle et définitive de participer à ce jeu concours.
2.6 La participation au jeu concours implique pour tout participant l'acceptation entière et sans réserve du présent règlement. Le non-respect dudit règlement entraîne l'annulation automatique de la participation et de l'attribution éventuelle
Du fait de l’acceptation du règlement, les participants autorisent l’organisateur à conserver les informations émises lors de leur inscription. Celle-ci s’engage à ne divulguer les informations données par les joueurs à de tierces personnes physiques ou morales.
Article 3 : Modalité de participation
Le Jeu se déroule comme suit : Le joueur peut se connecter depuis le lien vers le microsite de la campagne : https://shakr.cc/59ium
● Le joueur devra remplir un formulaire de participation
● Le joueur devra répondre à 3 questions et découvrira instantanément si il a gagné.
● Le joueur pourra tenter sa chance une fois par jour pendant la durée du concours.
● Le joueur peut enfin inviter des amis à joueur depuis facebook et X
● Le jeu sera organisé du 27 Février (10h00) au 6 Mars 2025 à 16h00 (heure française).
● Le tirage au sort parmi ceux qui auront bien répondu aux 3 questions, aura lieu le 6 Mars 2025 à 16h00

Article 4 : Dotation
Le Jeu est composé de la dotation suivante :
- 1 nuitée avec petit-déjeuner dans une chambre double avec vue mer pour deux personnes à l’Hôtel Westminster

Validité du Voucher : 01/03/2026*
Valeur du lot : selon la période du séjour le tarif varie entre 215 euros et 1050 euros
- 2 carte French Riviera Pass 24h pour visiter les sites incontournables de Nice et de ses environs
Valeur du lot : 28 euros par FRP soit 56 euros
*Sous réservation et soumis à disponibilité, hors période de congrès et Grand Prix de Monaco
Article 5 : Conditions d’attribution
Le gagnant sera informé de sa désignation dans les deux jours suivant la fin du jeu concours à l’adresse e-mail indiquée dans le formulaire de participation.
Le gagnant disposera d’un délai de 5 jours pour contacter la Société Organisatrice à l’adresse e-mail qui leur sera communiquée dans la notification électronique.
Si le gagnant prévenu ne se manifeste pas dans les 5 jours après l’envoi du courrier électronique, ce dernier sera considéré comme ayant renoncé à son lot et le lot restera la propriété de la Société Organisatrice.
Le gagnant devra se conformer au règlement. S’il s’avère que le gagnant ne réponde pas aux critères (n’ayant pas au moins 18 ans) du présent règlement, la Société Organisatrice ne pourrait alors lui attribuer sa dotation.
D’une manière générale, si l’adresse électronique ne correspond pas à celle du gagnant au moment de l’envoi d’informations relatives à son gain ou si des problèmes de réseau, coupure de courant, devaient empêcher l’acheminement de ces informations, la Société Organisatrice ne pourra en aucun cas en être tenue pour responsable.
La dotation ne pourra en aucun cas être reprise ou échangée contre toute autre dotation, ni transmise à des tiers. Cependant, en cas de force majeure ou si les circonstances l’exigent, la Société Organisatrice se réserve la possibilité de substituer à tout moment à la dotation proposée une dotation équivalente.
Article 6 : Fraudes
La Société Organisatrice se réserve le droit s’il y a lieu d’invalider et/ou d’annuler tout ou partie d’une participation s'il apparaît que des fraudes de toutes sortes ou des dysfonctionnements sont intervenus sous quelque forme que ce soit et notamment de manière informatique ou manuelle dans le cadre de la participation à l’Opération ou de la détermination du gagnant. A cette fin, La Société Organisatrice se réserve le droit notamment de faire procéder à des comparaisons des données techniques sur ses serveurs (notamment les IP) associées aux participations de l’Opération. La Société Organisatrice se réserve le droit de demander à tout participant de justifier son identité, et autres éléments justifiant le respect du règlement. La Société Organisatrice se réserve, dans toutes hypothèses et même en cas de doute, le droit de disqualifier les fraudeurs et/ou de poursuivre devant les juridictions compétentes les auteurs de ces fraudes.
La responsabilité de La Société Organisatrice ne saurait être engagée au titre de ce qui précède et les participants ne pourront donc prétendre à aucun dédommagement ou indemnité de quelque nature que ce soit.
Article 7 : Modification du règlement
La Société Organisatrice se réserve le droit, si les circonstances l'exigent, de modifier, écourter, prolonger ou annuler le jeu concours. Sa responsabilité ne saurait être engagée de ce fait.
La Société Organisatrice se réserve le droit de modifier tout ou partie du présent règlement. Toute modification du règlement fera l'objet d'une annonce sur la page et sera, le cas échéant, déposée si un tel dépôt est requis.
Article 8 : Vérification de l’identité des participants
Pour assurer le respect du présent règlement, La Société Organisatrice se réserve le droit de procéder à toute vérification de l’identité des participants, leur lieu de résidence. Toute indication d’identité ou d’adresse falsifiée, frauduleuse, fausse, mensongère, incorrecte, inexacte entraine l’élimination de la participation.
Article 9 : Responsabilité
La Société Organisatrice ne sera pas responsable en cas de dysfonctionnement du réseau internet empêchant l’accès au jeu concours ou son bon déroulement. Notamment, elle ne saurait être tenue responsable d’éventuels actes de malveillances externes.
Si La Société Organisatrice met tout en œuvre pour offrir aux utilisateurs des informations et /ou des outils disponibles et vérifiés, elle ne saurait cependant être tenue pour responsable des erreurs matérielles (notamment d’affichage sur les sites du jeu concours, d’envoi d’e-mails erronés aux participants, d’acheminement des emails), d’une absence de disponibilité des informations et/ou la présence de virus sur le site. La participation à ce jeu concours implique la connaissance et l’acceptation des caractéristiques et des limites de l’Internet, l’absence de protection de certaines données contre des détournements éventuels ou piratage et les risques de contamination par des éventuels virus circulant sur le réseau. Il appartient à chaque participant de prendre toutes les mesures appropriées de façon à protéger ses propres données et/ou logiciels stockés sur son équipement informatique et téléphonique contre toute atteinte. La connexion de toute personne au site et la participation au jeu concours se fait sous son entière responsabilité.
En outre, la Société Organisatrice n’est pas responsable en cas :
- De problèmes de matériel ou de logiciel
- De destructions des informations fournies par des participants pour une
raison non imputable à La Société Organisatrice
- D’erreurs humaines ou d’origine électrique
- De perturbations qui pourraient affecter le bon déroulement du jeu
concours
- De conséquences d’éventuels retard, pertes, vols ou avaries des
courriers postaux ou électroniques qui ne lui sont pas imputables. Les réclamations doivent être formulées par les destinataires directement auprès des entreprises ayant assuré l’acheminement desdits courriers.
Dans tous les cas, si le bon déroulement administratif et/ou technique du jeu concours est perturbé par une cause échappant à la volonté de La Société Organisatrice, celle-ci se réserve le droit d’interrompre le concours.
Toute fraude ou non-respect du présent règlement pourra donner lieu à l’exclusion du jeu concours de son auteur, La Société Organisatrice se réservant, le cas échéant, le droit d’engager à son encontre des poursuites judiciaires.
Article 10 : Informatique et Libertés
Les informations recueillies dans le cadre du présent jeu concours sont nécessaires à la prise en compte de votre participation. Ces informations sont destinées à La Société Organisatrice, responsable du traitement, aux fins de gestion de votre participation, pour la détermination des gagnants et pour l’attribution et l’acheminement des lots.
En participant au Jeu concours Scratch «Nice Hôtel Historique», le joueur pourra également solliciter son inscription à un courrier électronique d’information de la Société Organisatrice. Les données ainsi recueillies pourront être utilisées dans le cadre légal (mail opt-in actif).
Conformément à la loi Informatique et Libertés, vous disposez d’un droit d’accès, de modification, de rectification et de suppression des données vous concernant. Article 11 : Litiges
Toute contestation ou réclamation relative à ce jeu concours devra être formulée par écrit et adressée à L’Office de Tourisme Métropolitain Nice Côte d’Azur situé au 455 Promenade des Anglais – Immeuble Nice Plaza – 06200, NICE
La Société Organisatrice tranchera toute question relative à l’application du présent règlement, dans le respect de la législation française. Ces décisions seront sans appel. La loi applicable au présent règlement est la loi française et la langue applicable est la langue française. Tout différend né à l'occasion de ce jeu concours fera l'objet d'une tentative de règlement amiable. A défaut d'accord, le litige sera soumis aux juridictions compétentes dont dépend le siège social de La Société Organisatrice, sauf dispositions d'ordre public contraires. Aucune contestation ne sera plus recevable un mois après la clôture du jeu concours.
Article 12 : Informations générales
Il ne sera répondu à aucune demande (écrite, téléphonique ou orale) concernant les modalités ou le mécanisme du concours, l'interprétation ou l'application du présent règlement. ‘Nice Hôtel Historique’ contest rules
Article 1: Organising company
The Office de Tourisme et des Congrès Métropolitain de Nice Côte d'Azur, Établissement Industriel et Commercial, law of 11 July 1964, Siret N° 395 235 047, Code NAF 633 Z, whose registered office is at 455 Promenade des Anglais - Immeuble Nice Plaza - 06200, NICE, hereinafter referred to as the ‘Organising Company’, is organising from Thursday 27 February (10:00 a.m.) to Thursday 6 March 2025 (4:00 p.m. French time) a ‘Nice Hôtel Historique’ contest.
Any registration outside these dates will not be taken into account.

Article 2: Conditions of participation
2.1 Participation in this competition is open to all natural persons of legal age residing in mainland France (including Corsica) and abroad, with the exception of employees of the organising company.
2.2 Persons who have not provided proof of their full contact details and identity or who have provided them inaccurately or falsely will be disqualified, as will persons who refuse to allow the collection, recording and use of personal information concerning them and strictly necessary for the purposes of managing the competition.
2.3 Participation is strictly nominative (limited to a single person, same surname and first name, same e-mail address) for the duration of the competition, and it is therefore forbidden to participate under several pseudonyms or on behalf of other persons. Participation in this competition implies full and unreserved acceptance of these rules and a waiver of any right to appeal against the decisions taken by the organisers of the operation. At all times, the player is responsible for the accuracy of the information provided.
2.4 The organisers may not be held liable in the event of non-receipt of the entry, particularly in the event of communication cuts, connection difficulties or Internet network breakdowns occurring during the operation.
2.5 Counterfeit entries or entries made in a manner that contravenes these rules will result in the participant's disqualification. The competition organiser reserves the right to carry out any checks required for the application of this article. Proven intent to cheat or attempted cheating by a participant may be a participant may be penalised by a formal and definitive ban from taking part in this competition.
2.6 Participation in the competition implies full and unreserved acceptance of these rules. Failure to comply with these rules will result in automatic cancellation of participation and of any prize awarded.
By accepting these rules, participants authorise the organiser to keep the information provided at the time of their registration. The organiser undertakes not to divulge the information provided by the players to third parties, whether natural or legal persons.
Article 3: How to take part
The Game takes place as follows: The player can log on from the link to the campaign microsite:

Article 5: Award conditions
The winner will be informed of his/her designation within two days following the end of the competition at the e-mail address indicated in the entry form.
The winner shall have a period of 5 days to contact the Organising Company at the e-mail address provided in the electronic notification.
If the winner notified does not come forward within 5 days after the e-mail is sent, the winner shall be deemed to have renounced his/her prize and the prize shall remain the property of the Organising Company.
The winner must comply with the rules. If it turns out that the winner does not meet the criteria (not being at least 18 years old) of these rules, the Organising Company may not award the prize.

The Nice Côte d’Azur Metropolitan Convention & Visitors Bureau reserves the right, if necessary, to invalidate and/or cancel all or part of an entry if it appears that fraud of any kind or malfunctions have occurred in any form whatsoever and in particular in a computerised or manual manner in the context of participation in the Operation or the determination of the winner. To this end, our Company reserves the right, in particular, to compare the technical data on its servers (in particular the IP addresses) associated with the entries in the Promotion. The Nice Côte d’Azur Metropolitan Convention & Visitors Bureau reserves the right to ask any participant to provide proof of identity and other elements justifying compliance with the rules. The Organising Company reserves, in all cases and even in cases of doubt, the right to disqualify fraudulent entrants and/or to prosecute the perpetrators of such fraud before the competent courts.
The Nice Côte d’Azur Metropolitan Convention & Visitors Bureau may not be held liable for any of the foregoing and participants may not claim any compensation or indemnity of any nature whatsoever.
Article 7: Modification of the rules
The Organising Company reserves the right, if circumstances so require, to modify, shorten, extend or cancel the competition. The Organising Company may not be held liable in this respect.
The Organising Company reserves the right to modify all or part of these rules. Any modification of the rules will be announced on the page and, where applicable, will be filed if such filing is required.
Article 8: Verification of the identity of participants
To ensure compliance with these rules, the Organising Company reserves the right to carry out any verification of the identity of participants and their place of residence. Any falsified, fraudulent, false, misleading, incorrect or inaccurate indication of identity or address will result in elimination from participation.
Article 9: Liability
The Organising Company shall not be held liable in the event of a malfunction of the Internet network preventing access to the competition or its proper conduct. In particular, it shall not be held liable for any external malicious acts.
Although the Organising Company makes every effort to provide users with information and/or tools that are available and verified, it may not be held liable for material errors (in particular display errors on the competition sites, incorrect e-mails sent to participants, e-mail routing errors), lack of availability of information and/or the presence of viruses on the site. Participation in this competition implies knowledge and acceptance of the characteristics and limits of the Internet, the lack of protection of certain data against possible misappropriation or piracy and the risks of contamination by any viruses circulating on the network. It is the responsibility of each participant to take all appropriate measures to protect their own data and/or software stored on their computer and telephone equipment against any attack. The connection of any person to the site and participation in the competition is made under his entire responsibility.
In addition, the Organising Company shall not be liable in the event of:
- Hardware or software problems
- Destruction of information provided by participants for a reason not attributable to the Organising Company
- Human or electrical error
- Disruptions that could affect the smooth running of the competition
- The consequences of any delay, loss, theft or damage to postal or electronic mail for which the Organising Company is not responsible. Complaints must be made by the recipients directly to the companies responsible for delivering the said mail.
In all cases, if the smooth administrative and/or technical running of the competition is disrupted by a cause beyond the control of the Organising Company, the latter reserves the right to interrupt the competition.
Any fraud or failure to comply with these rules may result in the exclusion from the competition of the person responsible, with the Organising Company reserving the right, where applicable, to take legal action against that person.
Article 10: Information Technology and Civil Liberties
The information collected in the context of this competition is necessary for your participation to be taken into account. This information is intended for use by the Organising Company, which is responsible for processing it, for the purposes of managing your participation, determining the winners and awarding and delivering the prizes.
By participating in the ‘Nice Hôtel Historique’ Scratch Game, the player may also request to be registered for an information e-mail from the Organizing Body. The data collected in this way may be used within the legal framework (active mail opt-in).
In accordance with the French Data Protection Act, you have the right to access, modify, rectify and delete any data concerning you. Article 11: Disputes
Any dispute or claim relating to this competition must be made in writing and addressed to L'Office de Tourisme Métropolitain Nice Côte d'Azur located at 455 Promenade des Anglais - Immeuble Nice Plaza - 06200, NICE.
The Organising Company shall decide any question relating to the application of these rules, in compliance with French law. These decisions are final. The law applicable to these rules is French law and the applicable language is French. Any dispute arising in connection with this competition will be subject to an attempt at amicable settlement. If no agreement can be reached, the dispute shall be submitted to the competent courts having jurisdiction over the registered office of the Organising Company, except in the event of public policy provisions to the contrary. No dispute will be admissible one month after the end of the competition.
Article 12: General information
No requests (written, telephone or oral) concerning the terms or mechanism of the competition or the interpretation or application of these rules will be answered.
