“Win a flight every month for a year”
The promotion entitled “Win a flight every month for a year” is being carried out by VUELING AIRLINES, S.A. (hereinafter “VUELING”) with Spanish Tax Code A-63422141 and with registered address at Pla de l’Estany, 5, Polígono Empresarial Mas Blau II, El Prat de Llobregat (Barcelona).
PURPOSE OF THE PROMOTION
The purpose of this promotion (the “Promotion”) is to reward Vueling subscribers.
DURATION OF THE PROMOTION
The Promotion will take place from 17 to 24 April 2018 (Spain Time).
PARTICIPATION IN THE PROMOTION
Participation in the Promotion is open to all those persons of legal age and residing in any Member State of the European Union, except Italy.
No employee of VUELING or its associates, nor the direct relatives thereof, shall be entitled to take part in the Promotion.
By simply taking part, all participants in the Promotion shall accept the terms and conditions of this promotion and the regulations governing its implementation.
Furthermore, only the profiles of individuals may participate, thus excluding the profiles of groups, legal entities, companies, associations and the suchlike.
MECHANICS OF THE PROMOTION
The winning bookings must meet the following requirements:
i. Users will receive an email inviting them to participate.
ii. After receiving this invitation email, users must go to the landing page http://www.vueling.com/en/promo-draw-vy or http://www.vueling.com/en/promo-draw-vlg
iii. Confirm their subscription to the Vueling newsletter.
iv. Accept the legal terms and conditions of the Promotion.
VUELING will select six (6) winners randomly from the people who have signed up for the Promotion.
PRIZES
(i) The prize for the first (1st) winner of the Promotion is as follows:
A promotional code valid for twelve (12) Basic Fare tickets for return (or one-way) flights for two (2) people (winner and companion) to travel to any destination the winner chooses from the direct flights operated by VUELING, subject to seat availability and the terms and conditions of carriage published on the VUELING website.
Flights must be booked at least twenty-one (21) days before the departure of the first flight and in any case by 31 December 2019. The last flight must be taken by 20 January 2020.
(ii) The prize for the following five (5) winners of the Promotion is as follows:
A promotional code valid for one (1) Basic Fare return (or one-way) flight for two (2) people (winner and companion) to travel to any destination the winner chooses from the direct flights operated by VUELING, subject to seat availability and the terms and conditions of carriage published on the VUELING website.
Tickets must meet the following conditions:
Flights must be booked at least twenty-one (21) days before the departure of the first flight and in any case by 31 December 2018. The last flight must be taken by 20 January 2019.
VUELING shall not be liable for travel expenses to and from the departure and destination airports, of for board and/or lodging expenses incurred while waiting for the flight(s) to the chosen destination.
Neither shall VUELING be liable under any circumstances for travel, board and/or lodging expenses incurred by the winners during their stay at the destination.
The prize is non-transferable and changes of names, dates, times and destinations are not permitted.
Article 3 of Regulation EC 261/2004 does not apply to flights under this Promotion due to the fact that they are free tickets.
ANNOUNCEMENT OF THE WINNERS
Each winner of the Promotion will be informed of his or her success by e-mail sent to the corresponding registered e-mail addresses on 25 April.
In the event that a prize is waived, or if the winner in question cannot be contacted, the prize will automatically pass to the next person on the list of winners.
STATEMENT OF TRUTH
All information furnished by participants must be truthful. If false, VUELING will exclude the offending participant from the prize.
EXCLUSIONS AND LIMITATIONS
Under no circumstances may winners replace, change, alter, offset, transfer or sell their prize.
Winners will remain liable for all the tax obligations associated with the airline tickets awarded under this Promotion.
VUELING reserves the right to cancel the Promotion at any time and for any reason.
VUELING will not be held responsible for any error, interruption, defect, operational delay or late notification, theft, destruction, unauthorised access, or alteration when signing up for the draw, or for any malfunction, poor transmission or error in receiving any information from VUELING, or for any possible technical errors arising from Internet traffic, congestion or connection outages.
VUELING reserves the right to make modifications or add successive appendices to the rules and prizes of the Promotion, provided these are justified, are not detrimental to participants, and are duly communicated.
In the event that any claim is received concerning the violation of copyrights or any other legally protected rights, the offending photograph will be removed immediately once the violation has been communicated and proof provided to VUELING in writing. Such claims may be made by writing to legal@vueling.com.
CLAIMS PROCEDURE
Participants, by simply taking part in the Promotion, accept the Terms and Conditions of the Promotion and the VUELING dispute resolution procedure for any issue concerning these Terms and Conditions.
The maximum term in which a claim may be brought will be five (5) days starting from the date on which the winner is notified of his or her prize. Claims must be sent in writing to the registered offices of VUELING.
Both VUELING and the participants in the Promotion expressly agree that any dispute arising from the interpretation or application of these terms and conditions will fall within the jurisdiction of, and will therefore be heard before the courts of Barcelona.
DATA PROTECTION
Participants are hereby informed that the personal data they provide on occasion of this Promotion will be introduced into a filing system owned by VUELING AIRLINES, S.A. for the purpose of managing their participation in this Promotion.
Participants are likewise informed that they are entitled to exercise their rights of access, rectification, erasure and objection by sending written notice to such effect, accompanied by a photocopy of their passport or national identity card, to VUELING AIRLINES, S.A. Asesoría Jurídica, Plaça Pla de l’Estany, 5, 08820 (El Prat de Llobregat) Barcelona, SPAIN.
FORCE MAJEURE
VUELING accepts no liability for any possible force majeure or act of God that could affect the smooth running of the Promotion. Under no circumstances will VUELING be held liable for the improper rendering of services by any other person or entity whose involvement is required in order for the winners to enjoy their prize.
APPLICABLE LAW AND JURISDICTION
As this Promotion is intended exclusively for Spanish residents and is to be staged remotely within Spanish territory, it will be governed by the laws of Spain.
Any dispute or disagreement arising out of this Promotion will be heard before the judges and courts of the Spanish State, in accordance with the specific legal provisions that apply on a case-by-case basis.
WITHHOLDING TAX AND TAXATION OF PRIZES
In accordance with the provisions of the Personal Income Tax regulations, prizes awarded for participating in gambling activities, contests, raffles, or alternative types of gambling related to the sale or promotion of goods or services are subject to Personal Income Tax and the obligation exists to carry out a tax withholding or interim payment when the value of the prize exceeds the sum of 300 Euros.
The prizes awarded under this promotion shall be subject to the provisions of the Personal Income Tax Act 35/2006, of Royal Decree 437/2007, which approved the Personal Income Tax regulations; of Royal Decree 2069/1999, of 30 December, which approved the Articles of Association of the Public Business Entity “Loterías y Apuestas del Estado” [State Lotteries and Gambling]; of the Gambling Regulation Act 13/2011; and other concordant provisions, and accordingly, as the case may be, the company VUELING shall be responsible for carrying out the pertinent interim payment or the application of the withholding tax. Any other tax consequences applicable to the persons awarded the prizes shall be solely and exclusively the responsibility of said prize-winners.
