TERMS AND CONDITIONS #AWKWARD CHRISTMAS MOMENTS
By providing your details to us, Warner Music UK Limited whose registered address is at 90 High Holborn London WC1V 6XX (“Warner” “We” “us”) you confirm that you would like to enter the Competition (as defined below) to win the prize(s) set out below and you confirm your agreement to these terms and conditions.
1. ELIGIBILITY
1.1 You must be at least 14 years old to enter this Competition
1.2 Employees (and their families) of Warner, affiliate companies, agencies, and any other company or persons directly connected with the development or administration of the Competition, are not eligible to enter.
1.3 Residents of Quebec may not participate in this Competition
1.4 The #AwkwardChristmasMoments mechanic consists of 13 separate prize draws “Day 1”, “Day 2”, “Day 3”, “Day 4”, “Day 5”, “Day 6”, “Day 7”, “Day 8”, “Day 9”, “Day 10”, “Day 11”, “Day 12” and the “Grand Prize Draw”, (each and every and all together the “Competition”) further details of which including the respective start date (“Start Date”) and closing dates (“Closing Date”) for each and every Competition are set out on the website [www.awkwardchristmasmoments.com/].Warner accepts no responsibility for entries lost, damaged (for example by data corruption) or delayed, or for any inability to submit entries as a result of computer service, systems, software and/or server failure, error, interruption, defect or delay or any other technical malfunction, including problems with internet connectivity. Late, incomplete, incorrect, corrupt or suspected fraudulent entries will not be accepted.
1.5 Warner reserves the right in its absolute discretion to disqualify from this Competition any entrant who Warner believes has not complied with these terms and conditions.
2. HOW TO ENTER
2.1 It is free to enter this Competition. You will be entered into the Competition if you correctly answer the question(s) for the relevant Competition and when you click on the submit button to send us your details. We only allow one entry per person and per email address.
2.2 The use of software that permits automatic or multiple entries is not permitted. Warner reserves the right to disqualify anyone using such software, or who otherwise affects the validity or operation of the Competition.

“Grand Prize Draw prize” means each and every prize from Day 1 – 12 inclusive.
3.1 No cash alternatives will be available for any prize, but Warner reserves the right to substitute prizes of equal or greater value at any time if Warner withdraws the prize or it becomes unavailable.
4. THE WINNER
4.1 The Winner for each Competition shall be the person who correctly answers the relevant question(s) and is otherwise a valid entry. In the event that we receive more than one (1) valid correct answer to a Competition then the winner shall be drawn at random under independent supervision, from all valid and correct entries received. The decision is final and no correspondence will be entered into.
4.2 We will notify the winners by email using the contact details submitted and on the #AwkwardChristmasMoments website. If you are chosen as a winner and your contact details have changed since your entry, we reserve the right to disqualify your entry and draw an alternative winner.
4.3 The winner(s) must respond to us and accept the prize within forty eight (48) hours of our sending the notice. If the winner does not respond and accept the prize within forty eight (48) hours of our sending the notice, that entrant will no longer be considered the winner, our offer will be withdrawn automatically and we will select an alternative winner using the process set out above. If that entrant does not respond and accept the prize within forty eight (48) hours of our sending the notice, that entrant will no longer be considered the winner, our offer will be withdrawn automatically and we will select an alternative winner using the process set out above, and so on, until a winner accepts the prize. If the concert is less than three (3) days away at the date of our notification, we reserve the right to reduce the 48 hour time period for accepting the prize. We will indicate that reduced time period in our notification.
4.4 We may request that the winner provide proof of identity, age and residency. In the event of a dispute as to your identity, your entry will be deemed to have been submitted by the authorised holder of the email account from which the entry was submitted. The winner may be requested to provide Warner with proof that the winner is the authorised holder of the email account associated with the winning entry.
4.5 If any of the following circumstances apply, the winner will be deemed to have forfeited the prize and an alternative winner will be selected from the remaining eligible entrants using the process set out above:
(a) the prize (or any correspondence relating thereto, e.g. a notification from us confirming a winning entry) is returned as non-deliverable;
(b) the winner does not respond to a request to contact Warner within forty eight (48) hours of such request;
(c) the winner does not provide requested evidence of identity, age residency, or being the authorised holder of the email account from which the entry was submitted to Warner's satisfaction within forty eight (8) hours of such request being made; or
(d) Warner determines non-compliance with any of the terms and conditions.
4.6 The winner’s name(s) may be obtained by sending a stamped self-addressed envelope, marked #AwkwardChristmasMoments (including the name of the relevant competition e.g. Day 1, Day 2 etc) to 27 Wrights Lane, London, W8 5SW.
5. GENERAL
5.1 All prizes are non-transferable and there are no cash or other alternatives.
5.2 Warner may in its absolute discretion cancel or suspend the Competition and/or the prize(s) at any time if it deems it necessary or if circumstances arise beyond its control. No liability shall attach to Warner as a result thereof. In such circumstances, alternative prizes will be offered.
5.3 Except to the extent that they may not be excluded by law, no representations, warranties, terms or conditions that are not expressly stated in these terms and conditions apply to this Competition. Warner shall have no liability for any injuries, loss or damage of any kind arising from or in connection with participation in this Competition (including any damage to the entrant's or any other person's computer relating to or resulting from participation in, or downloading of any materials or software in connection with, this Competition) or acceptance, use, misuse or non-use of any prize (including activity or travel related thereto) except for liability for death, personal injury, fraud and damage or loss caused by negligence, which is not excluded.
5.4 Warner’s decision is final and binding in every situation including any not covered in these terms and conditions and no correspondence will be entered into.
5.5 Subject to applicable laws, Warner reserves the right to disqualify an entrant and/or winner in its absolute discretion.
5.6 A person who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
6. PUBLICITY AND DATA PROTECTION
6.1 By submitting an entry, entrants agree that Warner, its affiliates, service providers and/or agents may use any personal information submitted as part of the entry process (including contact details) for the purposes of operating the Competition, and administering prizes in accordance with Warner’s Privacy Policy, available at www.wminewmedia.com/privacy.
6.2 Winners may be required to take part in Warner promotional publicity in relation to the Competition. By entering into this Competition, you agree to provide, and that Warner may use, details of your name, likeness, voice, performance (if applicable) and county/country of residence for advertising and promotional purposes in connection with the Competition without additional authorisation, notice or compensation unless prohibited by law.
6.3 Winners agree to keep confidential any knowledge about Warner and its business and personnel received by them as a result of their prize and/or the Competition.
7. JURISDICTION
The Competition and these terms and conditions are governed by the laws of England and any dispute will be subject to the non-exclusive jurisdiction of the Courts of England.
